RECOMMENDATION:
Staff recommends City Council discuss and provide direction on the Manhattan Beach Municipal Code (MBMC) requirements in Title 9 (Building Regulations) pertaining to permit exemptions for fences.

BACKGROUND:
On November 19, 2019, the City Council adopted Ordinance No. 19-0015 (2019 California Building Standards Codes ("Codes") by reference) and associated Resolution No. 19-0095, adopting local amendments to those Codes. California Health and Safety Code Sections 17958.5 and 18941.5 allow local amendments if the City makes findings that those amendments are reasonably necessary due to unique local climatic, geological, or topographical conditions. Resolution No. 19-0095 established express findings for each local amendment based on one or more of these conditions.
The Codes include the California Building Code (CBC) and California Residential Code (CRC), both of which have an Administration section; local amendments to this section typically do not require justification through findings. Section [A] 105.2 and R105.2 of each respective Administration section includes a list of construction projects that are exempt from building permits. One local amendment made in the Administration section pertains to permit exemptions for fences.
