Recommended Action

RECOMMENDATION:
Staff recommends that the City Council adopt Resolution No. 20-0056:

 

1.                     Approving continued participation in the Los Angeles Urban County Community Development Block Grant (CDBG) Program by entering into a three-year Participating City Cooperation Agreement for the Fiscal Years (FY) 2021-2022, 2022-2023, and 2023-2024 with County of Los Angeles; and

2.                     Authorizing the City Manager, or designee, to execute any and all documents necessary for participation in the Los Angeles Urban County CDBG Program. 

 

FISCAL IMPLICATIONS:

This Participating City Cooperation Agreement does not contain any direct monetary obligations. However, by executing this agreement, the City will continue to be eligible to receive approximately $110,000 annually in federal Community Development Block Grant funds from Los Angeles County. These funds are designated annually in the City’s Capital Improvement Program (CIP) budget for construction of American with Disabilities Act (ADA) compliant improvements throughout the City.

 

BACKGROUND:

The mission of the CDBG Program is to improve the quality of life for low and moderate income persons, the disadvantaged community, aid in the prevention of neighborhood deterioration and meet other urgent community development needs. The City of Manhattan Beach is one of 48 participating (small) cities in the Los Angeles Urban County Community Development Block Grant (CDBG) Program. The Los Angeles Urban County CDBG Program is administered by the Los Angeles County Development Authority (LACDA), which receives CDBG funds directly from the U.S. Department of Housing and Urban Development (HUD) on behalf of the participating cities.

 

The last three-year, CDBG Agreement with the County of Los Angeles was approved by City Council on April 15, 2014. That agreement had an effective date of July 1, 2015, for CDBG Fiscal Years 2015-2016, 2016-2017, and 2017-2018. After the close of the three-year period, the agreement automatically renewed for another three years, through June 30, 2021. Note that it Los Angeles County’s process to begin executing CDBG agreements one full year before they become effective. Therefore, Los Angeles County is proceeding with requiring that participating cities approve their new, three-year CDBG agreements this year for an effective date of July 1, 2021.

 

DISCUSSION:

In order to continue participating in the Los Angeles Urban County CDBG Program, City Council must adopt a resolution and enter into a three-year Participating City Cooperation Agreement with Los Angeles County for FY 2021-2022, 2022-2023, and 2023-2024.  The attached agreement includes a provision for an automatic subsequent three-year renewal thereafter. The agreement also contains broad implementation language, some of which is clearly inapplicable to this City’s CDBG opportunities. This is primarily because the boiler plate agreement language covers a broad spectrum of eligible programs and requirements implemented by HUD. The attached resolution also authorizes the City Manager or designee to sign the Participating City Cooperation Agreement on behalf of the City Council. The Resolution further provides the City Manager to designate authority to the Public Works Director to execute CDBG Program contracts and agreements with LACDA, if necessary, due to minor variations and adjustments in CDBG programmatic requirements, as directed by LACDA.

 

With the execution of this Agreement, the City maintains its eligibility to receive an annual allocation of approximately $110,000 in federal CDBG funds for the construction of ADA compliant improvements and other vital community infrastructure projects, such as the CDBG-funded Manhattan Village Senior Villas and Soccer Field Facility ADA-Compliant Pathway Project.

 

PUBLIC OUTREACH:
Public outreach for the CDBG-funded projects will occur as those projects are implemented.

 
ENVIRONMENTAL REVIEW:

The City has reviewed the proposed action for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060 (c)(3) of the State CEQA Guidelines the activity is not subject to CEQA.  Thus, no environmental review is necessary.

LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
