RECOMMENDATION:
Staff recommends the City Council adopt Resolution 19-0080 (attachment):
1. Awarding a Construction Contract to CT&T Concrete Paving, Inc. for the Citywide Concrete Repair Project for $192,900.00.
2. Authorizing the City Manager to Execute the Agreement.
3. Authorizing the City Manager to Approve Additional Work, if Necessary, for up to $37,100 (19% of the contract).
4. Approving the Plans and Specifications for the Project.
FISCAL IMPLICATIONS:
The Citywide Concrete Repairs Project is in the Fiscal Year 2019-2020 approved Capital Improvement Program. There are sufficient funds available to complete the full bid scope of work for $192,900 and provide for additional unforeseen work, if necessary, for up to $37,100. The Budget and Expenditure Summary is attached.
BACKGROUND:
The Citywide Concrete Repairs Project involves upgrading many of the City’s existing damaged ramps to meet existing ADA standards; reconstructing damaged curbs, gutters and cross gutters; and removing and replacing specific deteriorated Portland Cement Concrete (PCC) pavement slabs and driveway approaches at various City locations. The construction contract also includes a unit bid item for repairing damaged sidewalks, which provides residential property owners the option to utilize the City’s bid rate for sidewalk repairs. Recall that Manhattan Beach Municipal Code Chapter 7.12 Sidewalk Repair assigns the responsibility for sidewalk repairs to the adjacent property owners. By incorporating an indefinitely quantities unit rate into the City’s bid documents, the City’s goal is to be able to provide homeowners a competitive, and hopefully less expensive option for having this necessary work completed with assistance from the City’s contractor. It saves residents not only time in coordinating the work themselves, but also in permitting and inspection fees that private contractors must pay.
DISCUSSION:
Bids for the Citywide Concrete Repairs Project (Bid No. 1212-19) at various locations, to be addressed quarterly, were solicited on a competitive basis in accordance with the provisions of the California Public Contract Code. The project was advertised for bid in the City’s publisher of record (Beach Reporter), in several construction industry publications, and was listed on the City’s website and BidSync-an online service that connects vendors, suppliers and contractors to government procurement opportunities. Staff also notified over 60 contractors on the City’s contractor database regarding this project.
A total of four competitive bids were received and opened on July 11, 2019. The bid results are as follows:

All bid packets were analyzed for arithmetical errors, completeness, accuracy, etc. CT&T Concrete Paving, Inc. included the Addenda Acknowledgment Form signed and dated but did not include Addendum No. 1 signed and dated. In consultation with the City Attorney’s Office, it was determined that this is a minor irregularity that can be waived. By executing the Addenda Acknowledgment Form, CT&T Concrete Paving, Inc. acknowledged that it is familiar with the Addendum No. 1. Lastly, staff reviewed the low bidder’s contractor license and found it to be in order and references indicate the contractor has the knowledge and capability to complete the work in a timely and acceptable manner.
Therefore, staff recommends that City Council authorize the City Manager to award a construction contract with CT&T Concrete Paving, Inc. for $192,900 and approve additional work, if necessary, for up to $38,580. Construction is anticipated to start in October 2019 and be completed by September 2020.
PUBLIC OUTREACH:
The businesses and residence impacted by this project will be provided advanced information regarding the project, including dates and times of construction. Contact information will also be provided for residents who require additional information. Notice will be sent to residences adjacent to the work once the project is ready to commence with construction.
ENVIROMENTAL REVIEW:
The City has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and had determined that the project qualifies for a Categorical Exemption pursuant to Section 15301 Class 1 (repair and maintenance of existing public facilities, involving negligible or no expansion of use) of the State CEQA Guidelines. A Notice of Exemption was filed with the Los Angeles County Clerk’s Office for the Project.
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
