RECOMMENDATION:
Staff recommends the City Council adopt Resolution No. 19-0013 (Attachment):
1) Awarding a construction contract to EBS General Engineering Inc. (EBS) for $159,800 and authorizing the City Manager to execute the contract;
2) Authorizing the City Manager to approve additional work, if necessary, for up to $31,960; and
3) Approving the plans and specifications for The Strand Resurfacing Project from 1st Street to 45th Street (Attachment).

FISCAL IMPLICATIONS:
The Strand Resurfacing Project is budgeted in the Fiscal Year (FY) 2018-19 Capital Improvement Program and has sufficient funding available to: 1) complete the scope of work for $159,800 and 2) provide for additional work, if necessary, up to $31,960. The Budget and Expenditures Summary is attached.
BACKGROUND:
Since its initial installation more than 10 years ago, the existing concrete surface on The Strand has become noticeably smoother, resulting in slick conditions under certain circumstances, particularly when it becomes wet and during rain events. Multiple residents have complained of extremely slick conditions when even a minimal amount of moisture is present. The Strand Resurfacing Project involves abrasive blasting of the existing concrete walking surface to increase surface traction for pedestrians; removing and repairing specific pavement and subgrade sections due to cracks or exposed rebar; and application of a sealant to the concrete surface.
City Council approved funding for this project in June 2018 as part the 2nd year CIP review process and budget adoption. Shortly thereafter, Public Works Engineering began detailed field investigations in preparation for developing design plans and specifications needed to procure repair services. Design plans were completed in fall 2018.
DISCUSSION:
Construction bids were solicited on a competitive basis on November 8, 2018 in accordance with the provisions of the California Public Contract Code. The project was advertised for construction bids in the City’s publisher of record (Beach Reporter), in several construction industry publications, and was listed on the City’s website and BidSync (online service that connects vendors, suppliers and contractors to government procurement opportunities). Staff also notified over 60 contractors on the City’s contractor database regarding this project.
A total of three (3) competitive bids were received and opened on December 11, 2018.

Public Works staff reviewed the apparent lowest bidder’s proposal, EBS General Engineering Inc. (Attachment), found it to be responsive with no errors, and determined it complied with the submittal requirements of the plans and specifications. Staff also reviewed EBS General Engineering Inc.’s contractor license and found it to be in order. Lastly, references indicate EBS General Engineering Inc. has the knowledge and capability to complete the work in a timely and acceptable manner.
Due to the difficulty in quantifying the extent of concrete deterioration through surface investigation only, certain areas may have more extensive subsurface cracking that was not immediately evident during preliminary concrete surface inspections. For this reason, staff recommends a higher 20% contingency in anticipation of unforeseen issues that may arise during construction. Therefore, staff recommends that City Council:
1) Authorize the City Manager to execute a construction contract with EBS General Engineering for $159,800; and
2) Approve a contingency for additional work, if necessary, for up to $31,960.
The work is anticipated to start in mid-March and be completed by late April 2019, prior to the summer tourist season. Working hours will be from 8:00 a.m. to 5:00 p.m., Monday through Friday, until the work is complete.
PUBLIC OUTREACH
Staff will distribute construction notices to area residents and maintain regular communication with adjacent property owners to keep them abreast of the project schedule and potential impacts during construction. Additionally, the City informed the Downtown Business and Professional Association representative about this upcoming project on December 11, 2018.
ENVIRONMENTAL REVIEW
In January 2019, staff filed a Notice of Exemption with the County of Los Angeles Clerk Office after determining this project qualifies for a Class 1(c) 15301 Categorical Exemption (Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities).
LEGAL REVIEW
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
