RECOMMENDATION:
Staff recommends that the City Council:
1. Accept as Complete the Live Oak Park Netting Improvements Project constructed by West Coast Netting Construction Services, Inc.;
2. Authorize filing of the appropriate Notice of Completion with the County Recorder’s Office; and
3. Approve the release of retention for $6,129.65 to West Coast Netting Construction Services, Inc.
FISCAL IMPLICATIONS:
The Live Oak Park Netting Improvements Project construction contract award was $106,593, with an authorized construction contingency amount of $16,000, for a total construction budget of $122,593. The work was successfully completed for $122,593. A $15,000 contribution from Verizon for the netting at Dorsey Field partially offset these construction costs in the CIP Fund.
BACKGROUND:
On November 21, 2017, City Council awarded a construction contract to West Coast Netting Construction Services, Inc. for construction of the Live Oak Park Netting Improvements Project. The construction work included:
• Installation of new steel support poles and nettings at Dorsey Field adjacent to the first base line and behind center field to limit balls from reaching the dog park and Valley Drive.
• New steel poles and netting adjacent to the third base line and outfield at Live Oak Field, which limits balls from reaching the basketball and tennis courts.
• Installation of bumper pads on seventeen poles at both fields to reduce the risk of injury to players.
DISCUSSION:
Construction began on July 16, 2018, and was completed on August 29, 2018. During that time, the City processed two change orders for the following additional work:
• $12,300 for three new light pole foundations at the Skate Spot to provide sufficient lighting during evening use periods.
• $3,700 to update the existing geotechnical engineering report for Live Oak Park.
The original budget plus two change orders brought the total cost of construction to $122,593, equaling the total project budget and contingency.
The Contractor has successfully completed all contract work and is now requesting formal acceptance of the project. The retention amount of $6,129.65 will be released 35 days after recordation of the Notice of Completion with the County Recorder. All work inspected by the Public Works Department has been found to be in conformance with the plans and specifications and of good quality.
PUBLIC OUTREACH/INTEREST:
The work was coordinated and scheduled to minimize impact to the area residents and businesses.
ENVIRONMENTAL REVIEW:
The project was determined to be exempt from the provisions of the California Environmental Quality Act (CEQA). Per the CEQA Guidelines, the project is exempt pursuant to the following provision: Section 15301 (f), “Addition of safety or health protection devices for use during construction of or in conjunction with existing structures, facilities”. No further environmental review is necessary.

The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
