Staff recommends that City Council adopt Resolution No. 18-0136 (Attachment) approving the submittal of a grant application to CalRecycle for rubberized pavement grant funds for the Liberty Village Pavement Rehabilitation Project and Marine Avenue Improvement Project.

FISCAL IMPLICATIONS:
There is no cost associated with submitting an application to CalRecycle’s rubberized pavement grant program. The grant is a competitive reimbursement program that awards funds based on the amount of rubberized pavement installed on projects. Staff estimates that the City is eligible to receive approximately $67,600 through this grant, based on the quantity of rubberized asphalt to be used on the planned Liberty Village Pavement Rehabilitation and Marine Avenue Improvement projects.
BACKGROUND:
CalRecycle administers this grant program to encourage diversion of waste tires from landfill disposal, prevent illegal tire dumping, and promote markets for recycled-content tire products. The Rubberized Pavement Grant Program is designed to promote markets for recycled-content surfacing products derived from California-generated waste tires. The practical benefits of using tire rubber in asphalt applications include achieving greater crack resistance, enhanced durability for a longer-lasting street pavement, safety and noise reduction, and ultimately cost savings to the City. The pavement also remains black in color for a longer period of time, giving it a “newer pavement look” and better contrast against the applied pavement striping and markings for enhanced roadway visibility. Notably, in a one-mile section of four-lane roadway, up to 8,000 tires are repurposed for this beneficial use, which further supports Manhattan Beach’s environmental sustainability core values.
For these reasons, the upcoming Liberty Village Pavement Rehabilitation Project and Marine Avenue Improvement Project will include rubberized asphalt hot mix on the top layer of street pavement improvements.
DISCUSSION:
The deadline to submit a grant application is October 3, 2018. For applicants located in Los Angeles County, each grant award is calculated on a base rate of $10 per ton of rubberized asphalt hot-mix, and the rate can be adjusted downward based on the number of previous rubberized asphalt pavement grants received by each organization. Based on available records, the City of Manhattan Beach has not previously received a rubberized pavement CalRecycle grant. Thus the City is eligible to receive the maximum grant reimbursement rate, estimated at approximately $67,600 for the estimated quantity of asphalt needed for the two pavement projects. Grant awards are expected to be announced in December, 2018, and available shortly thereafter.
The CalRecycle grant application procedures require an applicant’s governing body to declare, by resolution, authorization to submit the application. The authorization is effective for five (5) years from the date of adoption and may be applied to future applications. The resolution must also identify the signature authority for the application (e.g., the Public Works Director or designee) to sign all grant-related documents necessary to implement and close-out the grant(s) once awarded.
Therefore, staff recommends that the City Council approve the attached resolution in order for staff to submit a grant application to CalRecycle. Both projects will be bid this fall, with construction expected to commence in early 2019.
PUBLIC OUTREACH/INTEREST:
Initial public outreach has been conducted to the affected neighborhoods through mailers and a community meeting hosted at Marine Park. Additional public outreach for both projects will occur once the construction contracts are awarded and schedules are developed.
ENVIRONMENTAL REVIEW:
The City has reviewed the proposed activity for compliance with the California Environmental Quality act (CEQA) and has determined that the grant application submittal activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary.
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
