Recommended Action

RECOMMENDATION:

Staff recommends that City Council conduct a Public Hearing and adopt:

 

1.                     Resolution No.18-0110 (Attachment 1) authorizing: a) a proposed change to the City’s programmed CDBG Fiscal Year 2018-2019 Fund Appropriation of $106,801 (Project No. 601962-18) from “Installation of ADA Access Ramps, Cycle 3” into a new Fiscal Year 2018-2019 CDBG Project entitled “Manhattan Senior Villas Americans with Disabilities Act (ADA) Pathway Project,” and b) the City Manager or designee to execute all necessary contracts and agreements with the LACDC; and,

2.                     Resolution No. 18-0111 (Attachment 2): a) authorizing the City’s participation in the Revolving Grant Fund program with the Los Angeles County Community Development Commission (LACDC) and designating the City’s Fiscal Year 2019-2020 and Fiscal Year 2020-2021 CDBG annual combined allocation of approximately $213,602 to complete the Manhattan Senior Villas Americans with Disabilities Act (ADA) Pathway Project, and b) the City Manager or designee to execute all necessary contracts and agreements with the LACDC.  

 

FISCAL IMPLICATIONS:

Based on the most current information, the City of Manhattan Beach will receive an estimated $106,801 in CDBG funds in Fiscal Year (FY) 2018-2019. The City is also expected to receive a similar amount in FY 2019-2020 and FY 2020-2021, for a three-year total of approximately $320,403. The June 2018 adopted Capital Improvement Plan (CIP) Budget identified $100,000 in Streets & Highway (Gas Tax) funds and $300,000 in anticipated CDBG funds for the Village Field ADA Access Project. However, the final CDBG amount to be appropriated to this project will be revised when the actual allocation is known.

 

BACKGROUND:

The mission of the federal CDBG Program is to improve the quality of life for low and moderate income persons, aid in the prevention of neighborhood deterioration and meet other urgent community development needs. The City of Manhattan Beach has participated in the federal Housing and Urban Development (HUD) CDBG program, administered by the Los Angeles County Community Development Commission (LACDC), for the past twenty (20) years. One eligible use of CDBG funds is for the construction and/or reconstruction of safe paths of travel that are compliant with current American with Disabilities Act (ADA) standards. Due to the economic profile of Manhattan Beach, the City has very few projects and/or programs that qualify for CDBG funding. Mobility and access improvements for senior adults and disabled persons, such as this project, are one of the beneficial uses that the City can designate funds toward implementing.

 

New CDBG Project Proposed for Fiscal Year 2018-2019

On January 16, 2018, City Council adopted Resolution No. 18-0012, authorizing the allocation of FY 2018-2019 CDBG funds for $99,323 to construct approximately fifteen accessible ADA-compliant curb ramps (CDBG Project 601962-18, Installation of ADA Curb Ramps - Cycle 3) at various intersections citywide. This item was presented to City Council in January in order to meet LACDC programmatic deadlines. However, at the FY 2018-2019 “Budget Social” this past spring, a public request was made to improve pedestrian accessibility and mobility for disabled persons and senior adults between the Manhattan Senior Villas and Parkview Avenue, as well as provide pedestrian access to Manhattan Village Field and the adjacent Tot Lot.  Staff felt that this was indeed a high priority project that could be undertaken with $100,000 in FY 2018-2019 Gas Tax funds for design, coupled with the aggregated allocation of $320,403 of CDBG funding from FY 2018-2019, 2019-2020 and 2020-2021 for construction. 

 

DISCUSSION:

The LACDC CDBG Revolving Grant Fund allows cities to request an advance (e.g., loan) of up to two years of future CDBG funding allocations in order to implement larger projects. In addition to the City’s actual FY 2018-2019 annual allocation of $106,801, the City can request an additional two years of CDBG annual funding (approximately $213,602) for a total estimated allocation of $320,403.  There is no interest charged to the City for participating in the LACDC Revolving Grant Fund Program. Should changes occur in the future to the federal CDBG Program (for example elimination of the CDBG Program) the obligation to repay the loan is.

 

Resolution No. 18-0110: Cancellation of the Previously Adopted Project

On June 19, 2018 the City Council approved the City’s Capital Improvement Plan (CIP) Budget, which appropriated $100,000 in FY 2018-2019 year in Streets & Highway (Gas Tax) funds and approved $300,000 in anticipated CDBG funds for this proposed project (identified in the CIP as the Village Field ADA Access Project and CDBG Access Ramp Construction). Prior to budget adoption, staff submitted a revised CDBG Revolving Grant Fund application and was informed by LACDC on May 25, 2018 that its application for the Manhattan Senior Villas ADA Pathway Project qualified for, and could receive advanced funding for, implementation. However, under CDBG requirements, cancellation of the original approved project (Installation of ADA Curb Ramps - Cycle 3) represents a substantial change to the City’s FY 2018-2019 CDBG Program and requires that the City conduct a Public Hearing to provide the public an opportunity to comment on the City’s proposed new use of the CDBG Program FY 2018-2019 funds. If adopted after the Public Hearing, Resolution No. 18-0110 will cancel FY 2018-2019 CDBG Project 601962-18 for $106,801 and approve the new FY 2018-2019 CDBG Project, Manhattan Senior Villas, Installation of ADA Compliant Pathway. Please note that notice of the public hearing was advertised in the Beach Reporter, the City’s publisher of record a minimum of thirty days prior to this Public Hearing, on June 28, 2018.

 

The new project will include construction of concrete and asphalt surfaces, installation of ADA-compliant perimeter railing, ADA-compliant directional signage, ADA compliant curb ramps and sidewalks, striping and ADA parking spaces (Attachment).

 

Resolution No. 18-0111: Advancement of LACDC Funds

In order to participate in LACDC’s Revolving Grant Fund Program, Resolution No. 18-0111 must be adopted, which authorizes the City to receive two years’ advance of its annual CDBG allocation, or approximately $213,602 from the Revolving Grant Fund for FY 2019-2020 and FY 2020-2021. Under the terms of this program, the City agrees to repay the CDBG Revolving Grant fund from the City’s future CDBG allocations. This approach allows the City to fund a larger project, which provides an economies-of-scale cost advantage while also saving on administrative oversight and associated costs.

 

Staff recommends that City Council conduct the Public Hearing and adopt the attached resolutions. Both resolutions grant the City Manager or designee the authority to execute all related, necessary contracts and agreements with the LACDC, to make minor adjustments to the CDBG project (if necessary) due to minor variations in CDBG programmatic requirements, and/or to adjust funding allocations and commitments as directed by the LACDC.   

 

PUBLIC OUTREACH/INTEREST:
In order to comply with federal requirements pertaining to citizen participation and public outreach, the public was afforded a minimum of thirty days (30) notice of this Public Hearing held on August 7, 2018. The Notice of Public Hearing (Attachment) was published in the Beach Reporter on June 28, 2018.

 
ENVIRONMENTAL REVIEW
The City has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1(c) categorical exemption pursuant to Section 15301, Existing Facilities of the State CEQA Guidelines. Thus, no further environmental review is necessary.


LEGAL REVIEW
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
