RECOMMENDATION:

Staff recommends that the City Council:

 

1.                     Accept as complete the Marine Avenue Park Skate Spot Project constructed by Salix Development Company;

2.                     Authorize filing of the appropriate Notice of Completion with the County Recorder’s Office; and

3.                     Approve the release of the retention for $22,212.95 to Salix Development Company.Bo

FISCAL IMPLICATIONS:

On September 20, 2016, City Council approved a construction contract with Salix Development Company for $359,066 and authorized an additional contingency of $53,860, for a total construction budget of $412,926.00.  The project was successfully completed under budget for $405,481. An LA County Regional Park and Open Space District Grant is expected to reimburse the City for $300,000 of these costs.

 

BACKGROUND:

On June 7, 2016, City Council approved the Marine Avenue Park Skate Spot Design and Tom Allard Memorial Bench. Shortly thereafter, the project was advertised for the receipt of construction bids. On September 20, 2016, City Council awarded a construction contract to the low bidder, Salix Development Co., for $359,066 and authorized an additional contingency of 15%, for a total construction budget of $412,926. 

 

DISCUSSION:

Construction of the Skate Spot started on October 10, 2016 and was completed on March 10, 2017.  The City processed five change orders with Salix Development Co. for extra work during the course of construction, which included:

 

1.                     Installation of electrical conduit and three pull boxes for future lighting

2.                     Installation of an ADA-compliant drinking fountain

3.                     Relocation of irrigation lines

4.                     Installation of new sod

5.                     The application of anti-graffiti sealer to all exposed retaining walls and installation of one bronze dedication plaque

 

The total cost of the change orders was $35,709.47.  In addition, there were some savings in existing bid item quantities and deductions for certain miscellaneous work items, resulting in a total credit to the original contract of $6,560.00. Therefore, the final project cost totaled $388,215.47.  Additionally, the City utilized some of the contingency funds to purchase lighting and landscaping materials for the Skate Spot that were not identified in the Contractor’s scope of work, and for other incidentals needed to complete the project.

 

The Contractor has completed all contract work and is requesting formal acceptance of the project. The $22,212.95 in retention withheld from the payments will be released to the contractor 35 days after recordation of the Notice of Completion with the County Recorder. All work inspected by the Public Works Department has been found to be in conformance with the plans and specifications.

ENVIRONMENTAL REVIEW

The project is exempt from the provisions of the California Environmental Quality Act (CEQA).  Per the CEQA Guidelines, the event is exempt pursuant to the following provision:  Section 15304 (e), “Minor Alterations to Land”.

The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
