Recommended Action

RECOMMENDATION:

Staff recommends that the City Council:

 

a)                     Accept as complete the Pier Comfort Station Tile Mural and Sea Wall Tile Project constructed by Dekan Construction Corporation;

b)                     Authorize filing of the appropriate Notice of Completion with the County Recorder’s Office; and

c)                     Approve the release of retention for $1,215.92 to Dekan Construction Corporation.

FISCAL IMPLICATIONS:

A construction contract for $34,280.00 was awarded to Dekan Construction utilizing State Pier Funds to complete the project.  The work was successfully completed under budget for $24,318.40.

 

BACKGROUND:

On February 7, 2017 City Council awarded a construction contract to Dekan Construction Corporation for $34,280.00 to install tiles at the Comfort Station showers and the Sea Wall beneath the Pier.


DISCUSSION:

In the spring of 2016, the Pier Comfort Station was rehabilitated.  During construction, the existing tile mural at the Comfort Station shower wall (“Permanent Wave”) was removed because many of the shower tiles were cracked and stained.  Because this tile mural work was performed a tile contractor, staff capitalized on the opportunity to also repair the tiles at the Sea Wall beneath the Pier.  Replacement of damaged tiles began on May 17, 2017 and was completed on May 26, 2017.  The number of tiles needing replacement along the Sea Wall was significantly less than anticipated, resulting in a lower-than-expected final contract cost than originally awarded.

 

The contractor has completed all contract work and is now requesting formal acceptance of the project.  The five percent (5%) retention amount of $1,215.92 will be released 35 days after recordation of the Notice of Completion with the County Recorder.  All work inspected by the Public Works Department has been found to be in conformance with the contract documents and of good quality.  The remaining funds will be returned to the State Pier Fund Balance.


POLICY ALTERNATIVES:
Not applicable.

PUBLIC OUTREACH/INTEREST:
The work was coordinated and scheduled to minimize community impact during the summer season.

ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) requires public agencies to document and consider the environmental implications of their actions.  Based on the scope of work, the Project is categorically exempt pursuant to Section 15301, Class 1(b).  The project consists of a replacement and repair of existing tile murals involving negligible or no expansion of use beyond what previously existed.  A Notice of Exemption has been filed with the Los Angeles County Clerk’s office for the project.


LEGAL REVIEW
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
