RECOMMENDATION:
Staff recommends that the City Council:
1. Formally accept as complete the Cycle 1 Storm Drain Catch Basin Insert Project constructed by G2 Construction Inc.;
2. Authorize Filing of the appropriate Notice of Completion with the County Recorder’s Office; and
3. Approve the release of retention for $5,479.22 to G2 Construction.

FISCAL IMPLICATIONS:
The original Cycle 1 Storm Drain Catch Basin Insert Project construction contract award amount was $123,635, with an additional contingency amount of $12,364.00. The work was successfully completed under budget for $109,584.42.
BACKGROUND:
On February 7, 2017, City Council awarded a construction contract to G2 Construction, Inc. for $123,635.00 to install connector pipe screen (CPS) and automatic retractable screen (ARS) units at catch basins citywide, which is as one implementation measure to meet current MS4 NPDES Permit requirements for trash.
DISCUSSION:
Installations began on April 3, 2017 and were completed on June 27, 2017. The original contract called for installing either connector pipe screen units (internal mounting) or automatic retractable screen units (external mounting) at 170 locations. However, after further analysis, it was determined that 51 catch basin locations could be “bundled” together by installing one larger trash collection device downstream at a single collection point in the storm drain system. The 51 retractable screen planned for those catch basins were reassigned to 47 of the 119 remaining catch basins receiving connector pipe screens to enhance the trash capturing efficacy at those locations. Installation of both internal and external devices has the additional effect of reducing routine and long term maintenance costs and effort. This resulted in a contract savings of $16,340.00. Correspondingly, the City also processed a change order for $2,289.42 (Change Order #1) to cover the additional cost for the Contractor’s time to help staff assess the most suitable locations for 47 units that were redeployed. The final contract expenditure was contract was as follows:

The Contractor has completed all contract work and is now requesting formal acceptance of the project. The five percent (5%) retention amount of $5,479.22 will be released 35 days after recordation of the Notice of Completion with the County Recorder. All work inspected by the Public Works Department has been found to be in conformance with the plans and specifications and of good quality.
POLICY ALTERNATIVES:
Do not accept the construction contract to for the Cycle 1 Storm Drain Catch Basin Insert Project as complete and authorize filing of the Notice of Completion and release of retention.
PROS:
Funds would not be expended because the retention amount would not be released.
However, this would be inconsistent with the provisions of the executed contract that the Contractor must be fully paid for the work completed.
CONS:
The Contractor may be entitled to contract dispute claims resulting in additional cost incurred by the City.
PUBLIC OUTREACH/INTEREST:
The work was coordinated and scheduled to minimize impact to the area residents and businesses.
ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) requires public agencies to document and consider the environmental implications of their actions. Based on the scope of work, the Cycle 1 Storm Drain Catch Basin Connector Pipe Screen project is categorically exempt pursuant to Section 15301, Class 1(b). The project consists of the installation of connector pipe screens (CPS) installed across existing outlet pipes and installation of automatic retractable screen (ARS) along existing curb openings. A Notice of Exemption has been filed with the Los Angeles County Clerk’s office for the project.
