Recommended Action

RECOMMENDATION:

Staff recommends that the City Council conduct the Second Reading and adopt Ordinance No.17-0011, revising the Local Coastal Program regarding Appeals and Council Review of Decisions.

BACKGROUND:

At the June 20, 2017 City Council meeting, the City Council introduced Ordinance No. 17-0008 amending the Zoning Code Chapter on Appeals and Council Review. Specifically, the Ordinance: (1) Reinstated (a) the 15-day appeal and review period for planning decisions and (b) the requirement that appeals of Planning Commission decisions be filed with the Community Development Department; and

(2) Requires that a minimum of two Councilmembers must request review to enable Council review of Planning Commission quasi-judicial decisions.

 

After a duly noticed public hearing on July 5, 2017, the City Council adopted Ordinance No. 17-0008 and introduced Ordinance No. 17-0011, which contains the corollary revisions to the City’s Local Coastal Program to ensure consistency between the Local Coastal Program and the Zoning Code, and some minor non-substantive revisions.

 

PUBLIC OUTREACH/INTEREST:
This subject was discussed at the City Council retreat that was open to and attended by members of the public. Ordinance No. 17-0008 was introduced at the June 20, 2017 City Council meeting. A notice of the July 5 public hearing was advertised in the June 22, 2017 edition of the Beach Reporter, and the public hearing was held on that date.

LEGAL REVIEW
The City Attorney has approved as to form Ordinance No. 17-0011.
