RECOMMENDATION:

Approve the Second Amendment to the Master Agreement with Manhattan Beach Unified School District regarding use and maintenance of School District fields and facilities and authorize the Mayor to execute the agreement.

FISCAL IMPLICATIONS:

If the amendment to the agreement is approved, the City would pay twelve equal installments of $64,454.75 (1/12th of $773,457.00) for a one-year period (July 2017-June 2018). The additional yearly amount of $200,000 is in the proposed 2017-18 Budget.

 

BACKGROUND:

At the May 21, 2013 City Council meeting, City Council approved a Master Agreement with the School District for a three-year term.  The Agreement set forth payments of $550,000 annually with an annual CPI not to exceed $15,000. On May 18, 2016, the City and School District entered into the First Amendment to extend the term of the Agreement for one year.  2016’s annual payment to the School District was $$573,457 in exchange for use of fields, facilities and pools.

 

The Master Agreement was established to provide additional facilities to the community. The agreement included fourteen facilities with approximately 23 acres of open space including: fields, pools, and outdoor tennis and basketball court space for the City to schedule for the community. The Master Agreement provides valuable open space for the community, including Polliwog Park.  Due to recent construction activities, additional school facilities (e.g., a new gymnasium and new athletic field known as Meadows Field at Mira Costa High School) will become available for City and public use.


DISCUSSION:

If extended, the Master Agreement’s terms and provisions will be in effect for one year and will expire on June 30, 2018 (unless further extended at that time). The parties have expressed interest in a longer term agreement, but have agreed to a short-term extension with regular meetings to explore means of generating revenue. Staff thus recommends that the City Council extend the term of the Agreement for another year to provide the parties ample opportunity to negotiate a longer term agreement. Due to the increase in District facilities that will become available to the City and the public (e.g., a new gymnasium and new athletic field known as Meadows Field at Mira Costa High School), staff recommends that the Council authorize a $200,000 increase in the payment, from $573,457 to 773,457 (12 monthly payments of $64,454.75 annualized). In addition to the monthly payments for a year, the City will continue to provide field and facility maintenance, including all school fields, Polliwog Park, Begg and MCHS pool and tennis courts.


LEGAL REVIEW
The City Attorney has approved as to form the Second Amendment.

Approve the Second Amendment to the Master Agreement and authorize the Mayor to execute the agreement.
