Recommended Action
RECOMMENDATION:
Staff recommends that City Council adopt a Resolution approving the following:
1. Authorize the City Manager to execute a contract for $172,720.00 with EBS General Engineering, Inc. for the 3rd Street Improvement Project between Johnson Street and West End (Cul-de-Sac) (Attachments 1 and 5);
2. Authorize the City Manager to approve a contingency for $34,544 (20%) for additional work, if necessary.
3. Approve the plans and specifications for the 3rd Street Improvement Project (Johnson Street to West End (Cul-de-Sac). (Attachment 6: Web-link provided)

FISCAL IMPLICATIONS:
$350,000 is programmed in the Capital Improvement Budget for the project utilizing Measure R Local Returns. The Budget and Expenditure summary report is provided in Attachment 2.
BACKGROUND:
3rd Street is a residential cul-de-sac street located just west of Johnson Street. The street shows significant levels of pavement distress and has considerable drainage problems due to its relatively flat elevation, which have contributed to the degradation of the pavement and portions of its base. The construction project will include:
• Reconstruction of the roadway structural section (full pavement replacement)
• Installation of rolled curbs on both sides of the roadway to improve surface drainage flows while also allowing vehicle access to residential driveways.
• New modified curb returns and drainage spandrels at the intersection of 3rd Street and Johnson Street.
DISCUSSION:
The 3rd Street Improvement Project between Johnson Street and West End (Cul-de-Sac) was advertised for bids in the Beach Reporter, the City’s publisher of record, and several standard construction industry publications, including the Dodge Green Sheet, Reed Construction Data, and Associated General Contractors of America. Four bids were received and opened on April 24, 2017. The bid results are as follows:

EBS General Engineering’s bid proposal was reviewed by the Public Works Department and found to be responsive. Staff reviewed EBS General Engineering contractor’s license and found it to be in order. Additionally, references indicate EBS General Engineering has the knowledge and capability to complete the work in a timely and acceptable manner.
Staff recommends that City Council authorize the City Manager to execute construction contract with EBS General Engineering, Inc. for $172,720 and approve change orders up to $34,544 (20% of construction contract cost) for additional work resulting from unforeseen conditions. The higher contingency amount is prudent due to the possibility of encountering unsuitable soils beneath the existing roadway bed, unknown landscaping irrigation issues and possible plant material and hardscape improvements.
POLICY ALTERNATIVES:
Do not approve the construction contract for the 3rd Street Improvement Project between Johnson Street and West End (Cul-de-Sac).
PROS:
Capital Improvement Program funds will not be expended and the public will not be inconvenienced by construction in the area.
CONS:
The proposed improvements will still be necessary in the future if they are not constructed. Further delays in doing the improvements may result in portions of this roadway deteriorating to the point of not being drivable.
PUBLIC OUTREACH/INTEREST:
The City has conducted a neighborhood meeting in the Fall of 2016 and received full support for the project. The City has also had several email and phone communication with the neighborhood group to keep them apprised of the project progress. If City Council approves the construction contract award, outreach to the residents will happen prior to and during construction.
ENVIRONMENTAL REVIEW
The proposed project is exempt from the provisions of the California Environmental Quality Act (CEQA). Per the CEQA Guidelines, the project is exempt pursuant to the following provision: Section 15301, Class 1(c). A Notice of Exemption has been filed with the Los Angeles County Clerk’s office for the project.
LEGAL REVIEW
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
