Recommended Action
RECOMMENDATION:
Staff recommends that the City Council authorize the Acting City Manager to:
 
1.      Approve the issuance of a final payment in the amount of $23,026.17 to Taylor Tennis Court Inc. for the Live Oak Park, Manhattan Heights, Mira Costa Tennis Courts and Marine Avenue Park Basketball Courts Resurfacing and Restriping Project.
2.      Formally accept the Live Oak Park, Manhattan Heights, Mira Costa Tennis Courts and Marine Avenue Park Basketball Courts Resurfacing and Restriping Project as complete; and,
3.      Authorize filing of the appropriate Notice of Completion and the release of retention in the amount of $1,211.90.

FISCAL IMPLICATIONS:
Capital Improvement Program funds in the amount of $78,276 have been appropriated by City Council for this project. Please see Attachment 1 for budget, appropriation and contract payment details.
 
BACKGROUND:
The City maintains twenty-seven sports courts citywide. This includes twenty tennis courts and seven basketball courts. These courts need periodic resurfacing to maintain safe and serviceable conditions.
 
Since 1996, the Parks & Recreation Department received a yearly budget of $20,000 to  maintain courts and resurface at various parks throughout the City. Over the past 17 years, the budgeted amount to do this work has not changed, but as costs have risen, fewer courts were being addressed on the year-to-year cycle. With the current scope of work (resurfacing nineteen courts), the City has revamped its schedule for resurfacing to include the majority of courts every 3-4 years rather than resurfacing 4-5 courts each and every year. The approach improves efficiency and cost effectiveness through economies of scale.
 
On August 20, 2013, City Council authorized the City Manager to:
1.      Award a construction contract in the amount of $71,160 to Taylor Tennis Court Inc. for the Live Oak Park, Manhattan Heights, Mira Costa Tennis Courts and Marine Avenue Park Basketball Courts Resurfacing and Restriping Project;
2.      Transfer $20,000 from the General Fund to the Capital Improvement Project (CIP) fund;
3.      Appropriate $78,276 from the CIP Fund in order to complete resurfacing and restriping of all the courts in the project;
4.      Authorize the City Manager to approve additional construction work, if necessary, in an amount not-to-exceed $7,116 (10%).
 
DISCUSSION:
Construction started on September 25, 2013.
During the construction of the subject project, the Parks & Recreation Department received a proposed donation of $20,000 from Manhattan Beach Youth Basketball.  The donation was specifically for use at the Live Oak Park basketball courts to remove the existing basketball goals and replace them with new ones.  Two of the four goals would need to be adjustable.  In addition, two courts would need to be resurfaced after installation of the goals.
Staff approached Taylor Tennis Courts, Inc. with the proposal and negotiated a net cost for Change Order No. 1 in an amount not-to-exceed $28,342.38. On November 5, 2013, City Council authorized the City Manager to direct staff to expand the scope of work for the Live Oak Park, Manhattan Heights, Mira Costa Tennis Courts and Marine Avenue Park Basketball Courts Resurfacing and Restriping Project to include installation of adjustable basketball goals and resurfacing of courts in the form of Change Order No. 1 to Taylor Tennis Courts, Inc. for an amount not-to-exceed $28,342.38.
The Parks & Recreation Department requested that the Contractor delay construction until April so as not to disrupt the ongoing basketball league schedule.  As directed, the Contractor returned and completed the work in April.    
 
CONCLUSION:
The Contractor has completed all contract work and is requesting formal acceptance of the work and final payment in the amount of $23,026.17. A five percent (5%) retention in the amount of $1,211.90 would be released upon the expiration of 35 days after recordation of the Notice of Completion with the County Recorder. All work inspected by the Public Works Department has been found to be in conformance with the plans and specifications. A five percent (5%) retention in the amount of $3,333.00 was released to the Contractor in March because the contract portion of the work had been completed at that time.
