Recommended Action
RECOMMENDATION:
It is recommended that the City Council:
 
1. Authorize the City Manager to award a contract in the amount of $618,618 to Bannaoun Engineers Construction Corp. for the Street Resurfacing Project for Ardmore Avenue, Valley Drive and 11th Place;
2. Authorize the City Manager to approve additional construction work, if necessary, in an amount not-to-exceed $61,861 (10%).

FISCAL IMPLICATIONS:
Gas Tax funds in the amount of $582,696 have been appropriated by City Council for this project through the Fiscal Year 2011-2012 Capital Improvement budget, as well as Metropolitan Transportation Authority (MTA) STP-L funds in the amount of $117,304.   The 2012-2013 Capital Improvement Program has added an additional $200,000 in Gas Tax funds to the project, bringing the total to $900,000. Total expenditures are anticipated to be $850,513. A summary of budget, appropriations and anticipated expenditures is provided in Attachment 1.  
 
BACKGROUND:
The project will cold mill and overlay the pavement surface and replace displaced curbs, gutters and sidewalk.  The existing pavement on Ardmore Avenue, Valley Drive and 11th Place within the project limits is deteriorated and rehabilitation is required. Ponding occurs near Manhattan Beach Boulevard after rains and pavement deterioration in escalated due to dry weather drainage sheeting across the roadway.
 
On June 5, 2012, City Council awarded a contract to VA Consulting in the amount of $62,971 to prepare plans and specifications for this project.  
 
On June 25, 2013, City Council approved the plans and specifications and authorized the City Manager to solicit construction bids.
 
Environmental Review
The California Environmental Quality Act (CEQA) requires public agency decision makers to document and consider the environmental implications of their actions. Based on the scope of work, the project is categorically exempt pursuant to Sections 15301, Class 1(c). A Notice of Exemption has been filed with the Los Angeles County Clerk's office for the project.
 
DISCUSSION:
Bid Proposals
This project was advertised for bids in eight construction industry publications. Subsequently, 12 sets of plans and specifications were provided to contractors, subcontractors and material suppliers. A total of seven competitive bids were received and opened on July 25, 2013. The bids ranged from the low bid of $618,618 by Bannaoun Engineers Construction Corp. to the highest bid of $725,690.25.  
 
Bannaoun's bid was reviewed by the Public Works Department and found to be responsive. Representatives of agencies where work has been performed by Bannaoun have indicated that the work performed was to their satisfaction. The project was discussed with a representative of the firm and he expressed confidence in his bid and a desire to perform the work.
 
Additional Construction Work Authority
Authorizing the City Manager to approve additional work in an amount not-to-exceed $61,861 (10% of contract) would expedite construction of this project.  If the contingency is approved, staff will report the status of any additional work to the City Council at the end of the project.
 
Project Schedule
With the start of construction scheduled for late September or October, the contractor will be made aware of two critical periods that will affect the construction schedule.  The first event is the 10K run scheduled for October 5, 2013.  The contractor will have to have a safe course for the run to take place.  That will mean no vertical lips that will cause a tripping hazard for the participants or spectators and it will likely mean a lost day of production while the contractor does one last review of the construction area to ensure a safe space for the citizens of Manhattan Beach.  The second critical area will be the time between Thanksgiving and New Year's.  To ensure that the holiday buying season is preserved for the downtown businesses, the contractor will need to minimize traffic closures during this period.
 
CONCLUSION:
Staff recommends that the City Council:
 
1. Authorize the City Manager to award a contract in the amount of $618,618 to Bannaoun Engineers Construction Corp. for the Street Resurfacing Project for Ardmore Avenue, Valley Drive and 11th Place;
2. Authorize the City Manager to approve additional construction work, if necessary, in an amount not-to-exceed $61,861 (10%).
