Recommended Action
RECOMMENDATION:
Staff recommends that the City Council waive further reading, adopt the findings contained in the staff report, and adopt Ordinance No. 16-0036 and Ordinance No. 16-0001, prohibiting cultivation of medical marijuana in the City and in the City's Coastal Zone, and adopt Resolution No. 16-0012 authorizing the submission of Ordinance No. 16-0001 to the California Coastal Commission.

There are no fiscal impacts associated with the adoption of the ordinances.
BACKGROUND
On January 5, 2016, the City Council introduced Ordinance Nos. 16-0036 (Zoning Code Amendment) and 16-0001 (Local Coastal Program Amendment). At this time, staff recommends that the City Council adopt Ordinance Nos. 16-0036 and 16-0001 and Resolution No. 16-0012. The redline-strikeout versions of the Ordinances indicate the minor non-substantive revisions since the first reading on January 5, 2015.
DISCUSSION
The Medical Marijuana Regulation and Safety Act ("MMRSA") requires a city to take affirmative action if it wants to prohibit or regulate the cultivation of medical marijuana within its jurisdiction.
