Recommended Action
RECOMMENDATION:
It is recommended that the City Council adopt by Resolution the attached Side Letter Agreement with the City of Manhattan Beach Police Management Association (PMA) modifying Chapter 2, Article 5 Compensation/Salaries and Exhibit A, Salary Schedule of the Memorandum of Understanding (MOU). The City Council adoption will authorize the City Manager to execute the Side Letter Agreement and take appropriate actions necessary to carry out the terms of the Side Letter Agreement.
FISCAL IMPLICATIONS:
The Side Letter Agreement modifies the salary range maximum for the Police Captain position and results in a slight savings to the FY16-17 adopted budget.
BACKGROUND:
In December 2015, the City Council approved the PMA MOU January 1, 2016 to December 31, 2018 including salary range increases for the Police Captain position. It was subsequently discovered that an error had occurred resulting in the Police Captain salary range as provided in the MOU being lower than the current salary of an incumbent.
DISCUSSION:
The PMA representatives and City representatives met to discuss the mutual error which had occurred during the contract negotiations and options for resolving the error. The parties agreed upon a resolution which includes increasing the salary range for the Police Captain classification to be equal to the salary currently paid. In addition, the parties agreed that the increase provided for in the MOU of 3.75% in January of 2017 would be applied only to the extent that the salary range is not exceeded.
Appendix A of the PMA MOU will reflect a Police Captain base salary range effective January 1, 2016 of $14,344 to $15,733 and providing for no increase to the salary range for subsequent years of the MOU.
POLICY ALTERNATIVES:
The recommended action is administrative in nature and there are no viable alternatives.
PUBLIC OUTREACH/INTEREST:
Staff determined that public outreach was not required for this issue.
LEGAL REVIEW
The agreement has been reviewed and approved by the City Attorney’s office as to legal form.
