Recommended Action

RECOMMENDATION:

Staff recommends that the City Council:

1.                     Approve the Specifications for the Live Oak Park, Mira Costa High School and Marine Avenue Park Tennis and Basketball Courts Resurfacing and Restriping Project;

2.                     Reject the low bid as non-responsive;

3.                     Authorize the City Manager to execute a contract in the amount of $35,499 with Taylor Tennis Court, Inc. for the Live Oak Park, Mira Costa High School and Marine Avenue Park Tennis and Basketball Courts Resurfacing and Restriping Project; and Authorize the City Manager to approve additional work, if necessary, in an amount not-to-exceed $3,500 (10%).

FISCAL IMPLICATIONS:

Adequate funds are included in the Fiscal Year 2016-2017 Park Maintenance and School Maintenance budget for court resurfacing as detailed in Attachment No. 1.

 

BACKGROUND:

The City maintains twenty-seven sports courts citywide. This includes 20 tennis courts and seven basketball courts. These courts need periodic resurfacing to maintain safe and serviceable conditions. The City resurfaces each court every 3-4 years. The approach improves efficiency and cost effectiveness through economies of scale.


DISCUSSION:
   

State Law requires competitive bidding for “public projects” in excess of $5,000.  State law provides:  “When the expenditure required for a public project exceeds five thousand dollars ($5,000), it shall be contracted for and let to the lowest responsible bidder after notice.”  Pub. Contract Code § 20162.  For the purpose of this section, the term “public project” includes projects “for the erection, improvement, painting, or repair of public buildings and works.”  Public Contract Code § 20161(a).

 

California law requires the payment of prevailing wages for “public works” projects of more than $1,000.  Labor Code § 1771.  Section 1720 defines “public works” to include “construction, alteration, demolition, installation, or repair work done under contract and paid for in whole or in part out of public funds.”  Labor Code § 1720(a).

 

In addition, the low bid contractor is required to provide a bid bond, performance bond, labor and material bond, defective materials, general insurance and auto insurance, further escalating the overall cost of a Public Contract.

 

Construction Bid Proposals

This project was advertised for bids in the Beach Reporter, the City’s publisher of record, and several standard construction industry publications, including the Dodge Green Sheet, Reed Construction Data, and Associated General Contractors of America.  Four bids were received and opened on July 20, 2016 which ranged from a low of $30,600 to a high of $55,000 (Attachment 2). 

 

The apparent low bid ($30,600) was from Trueline Construction and Surfacing, Inc.  However, Trueline Construction’s bid was found to be non-responsive by the Public Works Department for failing to comply with instructions to include a signed copy of an addendum in their proposal package as required.  Consequently, staff is recommending award of the contract to the next lowest bidder, Taylor Tennis Court, Inc. ($35,499).

 

Taylor Tennis Court’s bid was reviewed by the Public Works Department and found to be responsive. Staff reviewed Taylor Tennis Court’s contractor’s license and found it to be in order.  Additionally, references indicate Taylor Tennis Court has the knowledge and capability to complete the work in a timely and acceptable manner.

 

Project Schedule

The resurfacing is scheduled to be completed in 25 working days.  The proposed start date for construction is scheduled for mid-October in order to work around planned activities at the affected facilities.  In-house Engineering staff will be performing inspection of the work.

 

Bid Opening:                                                                                    July 20, 2016

Award Contract:                                                               September 6, 2016

Start Construction:                                          Mid-October, 2016

Completion of Project:                     Mid-November, 2016

 

The resurfacing work will include the following locations:

 

                     Two tennis courts at Live Oak Park

                     Two basketball courts at Live Oak Park

                     Two tennis courts at Mira Costa High School

                     Two basketball courts at Marine Avenue Park

 

Authorization of Construction Contingency

It is recommended that the City Manager be authorized to approve change orders in an amount not-to-exceed $3,500 (10% of contract cost) for additional work resulting from unforeseen conditions.


POLICY ALTERNATIVES:

Do not approve the construction contract to resurface and restripe the Live Oak Park, Mira Costa High School and Marine Avenue Park tennis and basketball courts.

     PROS:
     Funds would not be expended on resurfacing and restriping the Live Oak Park, Mira

     Costa High School and Marine Avenue Park tennis and basketball courts.
     CONS:
    
The tennis and basketball courts at Live Oak Park, Mira Costa High School and 

     Marine Avenue Park are in need of resurfacing and restriping. If the construction  

     contract is not approved, maintenance repairs will still be required at some point in

     time.
    

PUBLIC OUTREACH/INTEREST:

After analysis, staff determined that public outreach was not required for this issue. The work will be coordinated and scheduled to minimize impact to the applicable park activities.

ENVIRONMENTAL REVIEW

The City has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1(c) categorical exemption pursuant to Section 15301, Existing Facilities of the State CEQA Guidelines. Thus, no further environmental review is necessary.

LEGAL REVIEW

The City Attorney has reviewed and approved the proposed Agreement as to form.
