RECOMMENDATION:

Staff recommends that the City Council discuss and provide direction on the request by Mayor Franklin and Councilmember Montgomery to waive third-party public safety costs for the 2024 Manhattan Beach 10K.

 

FISCAL IMPLICATIONS:

Third party costs for CSC security services, paid by the Manhattan Beach 10K to reimburse the City were $2,558 in 2022 and $5,159 in 2023. The estimated CSC security costs for the 2024 event are not expected to exceed $6,000.  Third party costs may be reduced or eliminated based on the number of volunteers provided by the MB10K, reducing the need for CSC staffing.

 

BACKGROUND:

Mayor Franklin and Councilmember Montgomery requested that this item be placed on the agenda at the July 16, 2024, City Council meeting.


At its discretion, the City Council may grant fee waivers for legacy events. The MB10K has a 100 percent fee waiver for City services, resources, fees for City permits, and the special event application fee.  The Special Events policy, approved in July 2018, section 1.J states that fee waivers do not apply to any third-party costs incurred to support an event, and section 5.D states that all third-party costs incurred by the City to support an event will be billed to the event organizer.


DISCUSSION:

The level of security personnel is determined by the Police Department. As such, the organizer may not have control over the expenses making it difficult to budget. In some cases, security costs may be reduced or eliminated by utilizing volunteers, however many of the organizers have expressed difficulty in securing volunteers.

 

The MB10K is requesting a waiver of all third-party public safety costs for services ordered by the Police Department for the October 5, 2024, event. The estimated cost based on 2023 staffing for the event should not exceed $6,000.

 

In the past, proceeds from the MB10K have been used to fund City projects. Most recently, the MB10K purchased new equipment for the Strand Parcourse workout station and has committed $30,000 for the NFC Fitness Court at Polliwog Park.

 

Fee waivers for all legacy events will return to City Council for consideration in early 2025, for fiscal years 2026-2030.

 

PUBLIC OUTREACH:
After analysis, staff determined that public outreach was not required for this issue.

 

ENVIRONMENTAL REVIEW:
The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that there is no possibility that the activity may have a significant effect on the environment; therefore, pursuant to Section 15061(b)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary.


LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
