RECOMMENDATION:
Staff recommends that the City Council adopt Resolution No. 24-0136 approving Amendment No. 1 to the Professional Services Agreement with Faith Group, LLC for additional inspection services in the amount of $119,760 for the Citywide Security Cameras Project - Phases 1 and 2.
FISCAL IMPLICATIONS:
Sufficient funds of $119,760 are currently available for Amendment No. 1 to the Professional Services Agreement with Faith Group, LLC for Additional Inspection Services for the Citywide Security Cameras Project within the CIP Fund. A Project Budget and Expenditures Summary Report is attached.
BACKGROUND:
On September 19, 2023, City Council awarded a construction agreement with Blue Violet Networks (contractor) for a not-to-exceed amount of $523,820.17 for Phases 1 and 2 of the Project. Phases 1 and 2 include installations at the Public Works Yard, City Hall, and the Police/Fire Facility. These phases, and the future Phase 3 project, focus on enhanced security for employees and visitors at City Hall and other facilities as identified in a 2021 assessment report.
On December 5, 2023, City Council awarded a Professional Services Agreement to Faith Group LLC for construction inspection of the installation of security cameras included in Phases 1 and 2 for a not-to-exceed amount of $159,680.
DISCUSSION:
Construction of the Citywide Security Cameras Project - Phases 1 and 2 began in February 2024 with the Public Works Yard (Yard). Several unforeseen delays were encountered at the Yard, which resulted in re-designs, procurement of additional equipment and materials, and longer-than-anticipated installation. The delays were primarily due to the following:
• The designed camera mounts were not feasible at several locations at the Yard buildings due to existing conditions.
• Existing network conditions at the Yard did not meet telecommunication distribution and security system standards and recommendations from the Information Technology Department.
Currently, construction activities are ongoing at City Hall and the Police/Fire Facility. All work performed by the contractor and associated vendors is independently inspected by Faith Group, LLC, whose scope of work includes:
• Ensuring the contractor complies with the plans, specifications, and applicable standards;
• Performing field project oversight;
• Documenting the daily work performed by the contractor;
• Verifying the completed work; monitoring, providing supporting documentation, and inspecting any additional work performed; and
• Preparing a list of items for correction.
Faith Group’s contract was based on the Project’s original construction duration of 6 months. Faith Group has managed its resources efficiently and was able to extend their inspections services through October 2024 for a total of 9 months. However, the project requires an additional three months of construction to complete the remaining work at City Hall and Police/Fire Facility. The additional services to be rendered under Amendment No. 1 will increase the contract amount by $119,760 for a maximum compensation of $279,440 and extend the contract term to June 30, 2025.
PUBLIC OUTREACH:
Staff has determined that community public outreach is not required for Phase 1 and 2 of the Project. Outreach has been ongoing with City employees and will continue as the Public Safety Camera System Policy is developed. The RFP for these professional services was advertised on the City's website and on PlanetBids, a public bid notification platform.
ENVIRONMENTAL REVIEW:
The City has reviewed the proposed Citywide Security Cameras Project and associated contract for compliance with the California Environmental Quality Act (CEQA) and has determined that there is no possibility that the activity may have a significant effect on the environment; therefore, pursuant to Section 15061(b)(3) (the “common sense” exemption) of the State CEQA Guidelines, the project is exempt from CEQA. Additionally, the project qualifies for a categorical exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines, given that the project consists of minor alterations of existing public structures, with negligible or no expansion of use. Furthermore, there are no features that distinguish this project from others in the exempt class; therefore, there are no unusual circumstances.
LEGAL REVIEW:
The City Attorney has approved the amendment as to form and has reviewed this report and determined that no additional legal analysis is necessary.
