Council consider the request by the Mall to approve nighttime construction hours.

BACKGROUND:

Currently, the City’s code does not allow construction activity outside of the hours and days specified in Manhattan Beach Municipal Code Title V, Chapter 5.48 (Noise Regulations).

 

As part of tonight’s agenda, Council will consider Ordinance 16-0007 to amend the Municipal Code to allow modified construction hours. Should Council approve the Ordinance as written, this request may be considered under the revised ordinance provisions.


DISCUSSION:

The managers of the Village Shopping Center are requesting nighttime work to be performed Monday through Sunday, between the hours of 9 p.m. and 10 a.m., commencing on June 8, 2016 with work scheduled to be completed by May 1, 2017 (excluding holidays). Work will be performed only in the interior of the mall and will involve replacing outdated restrooms, flooring, lighting, signage and furniture. As described in the attached letter (Attachment 1), the mall representatives do not believe that the planned construction work will impact adjacent residents or businesses.

Furthermore, performing this large-scale renovation work during mall operating hours would be prohibitive as it would expose customers to the hazardous nature of construction, as well as, negatively affect store accessibility and sales.

Council may consider the request in light of the criteria listed in the staff report for proposed Ordinance 16-0007. The Council may also impose conditions to mitigate or eliminate any adverse impacts arising from the activity.

Council may consider limiting the days and/or hours of the proposed request.

Could lead to drop in revenue for businesses at the shopping center who may have to close or limit daytime commercial activity to perform construction that could otherwise be performed at night. Could impact sales tax revenues.
