Recommended Action

RECOMMENDATION:

Staff recommends that the City Council:

 

1)                     Formally accept as complete the CT&T Concrete Paving, Inc. construction contract;

2)                     Authorize the filing of the Notice of Completion with the County Recorder; and

3)                     Release the retention of $8,221.55.

FISCAL IMPLICATIONS:

The Citywide Concrete Repairs Cycle 1 Project construction agreement was awarded in the amount of $208,250 with an authorized construction contingency amount of $41,750. The work was successfully completed for $164,431.00. After acceptance of CT&T Concrete Paving’s work and the filing of the Notice of Completion, retention will be released and the remaining unexpended balance will be disencumbered and remain in the Annual Citywide Concrete Repairs Program within the Gas Tax Fund for use in a future cycle of curb, gutter, and ramp replacement.

 

BACKGROUND:

On January 18, 2022, the City Council awarded a construction agreement to CT&T Concrete Paving Inc. (CT&T), as the successful lowest bidder, for $208,250 for the Citywide Concrete Repairs Cycle 1 Project. City Council also authorized the City Manager to approve additional work for up to $41,750.

 

The purpose of the City’s Annual Curb, Gutter, and Ramp Replacement Program is to repair existing cracked, damaged, or lifted sections of concrete roadway, curb, gutter, and cross-gutters. Improvements also include fixing portions of the sidewalk to meet current Americans with Disabilities Act (ADA) standards, removal of obstructions, and correction of drainage issues. Additionally, concrete repairs eliminate trip hazards, increase pedestrian accessibility, reduce ponding of surface water, and improve roadway safety and rideability.


DISCUSSION:

CT&T was issued a Notice to Proceed on March 10, 2022 and their work was substantially completed on July 7, 2023.

One change order was executed with CT&T Concrete Paving, Inc. and included the following changes to the contract’s work:

 

1.                     Adjustment in Final Bid Quantities,

2.                     Removal and replacement of one damaged tactile warning panel, and

3.                     Replacement of 17 linear feet of double yellow traffic striping.

 

Change Order No. 1 reduced the $208,250 contract amount by $43,819, with no change in working days. Therefore, the contractor has completed all contract work for a total cost of $164,431.00 and is now requesting formal acceptance of the project. The retention amount of $8,221.55 will be released 35 days after the recording of the Notice of Completion with the County Recorder. All work inspected by the Public Works Department has been found to be of good quality and in conformance with the plans and specifications.


PUBLIC OUTREACH:
The businesses and residences impacted by this project were provided advance notices including dates, times of construction, and contact information for the contractor’s project manager.


ENVIRONMENTAL REVIEW:

The City reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA). At the time of award, the City Council determined that the project qualifies for a Categorical Exemption pursuant to Section 15301 Class 1 (C) (Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities) of the State CEQA Guidelines. A Notice of Exemption was filed with the Los Angeles County Clerk’s Office for the Project, and no further environmental review is necessary for this action.


LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
