Recommended Action

RECOMMENDATION:

Staff recommends that the City Council recognize outgoing City Councilmembers Richard Montgomery and Nicholas Tell for their commitment and dedication to the City of Manhattan Beach; introduce re-elected Councilmember Wayne Powell; newly elected Councilmembers Mark Burton and Tony D’Errico; and re-elected Treasurer Tim Lilligren.

BACKGROUND:

Following the certification of the election results, Section 10265 of the California Elections Code requires that the City Clerk/elections official shall immediately sign and deliver to each person elected a certificate of election.  The elections official is also required to administer to each person elected the oath of office prescribed in the California Constitution.

 

DISCUSSION:

The certification of the election results was presented to the City Council on March 19, 2013, and the certification was ratified.  Following the certification of these results, the City Clerk is required to administer the oath, as provided in the California Constitution, and provide each newly elected officer with a Certificate of Election.

 

The following candidates were elected to the three City Councilmember seats:

 

1. Wayne Powell: 3,986 votes received.

2. Mark Burton: 2,973 votes received.

3. Tony D’Errico: 2,393 votes received.

 

The following candidate was elected to the office of City Treasurer:

 

1. Tim Lilligren: 3,903 votes received.

 

City Council Seating Order

Past precedent has used the vote count results to determine the order of seating.  This has been done to follow the spirit of Government Code section 57377 which uses vote count to determine seating when the first city council of any new city is seated.  However, staff does not believe that a written local policy to this affect for ongoing seating order exists.

 

In light of the recent election, two members were termed out (Montgomery, Tell) leaving open seats and one member (Powell) was reelected.  The remaining members (Lesser, Howorth) will remain and the three recently elected members will be seated following them.  Based on past precedence, the newly elected members would be seated in order based on the number of votes they received.  Councilmember Powell received the highest number of votes, followed by Councilmember Burton and Councilmember D’Errico.
