Staff recommends that City Council:
1. Approve professional services agreement with Anderson Penna for Project Management Services for the Roundhouse Aquarium Project in the amount of $145,898,
2. Authorize the City Manager to approve a professional services contingency in an amount not-to-exceed $14,590,
3. Authorize City Manager to execute agreement.

FISCAL IMPLICATIONS:
The proposed aquarium renovation project is expected to be primarily funded by the Harrison Greenberg Memorial Foundation (Foundation). The Foundation has pledged $1.25 million towards the project and will undertake additional fundraising efforts to meet the estimated total project cost range between $1.6M and $2.5M. Per the Cooperative Agreement for the Roundhouse Aquarium project, the Foundation will be depositing $160,488 with the City to fund this effort prior to the City entering a contract with Anderson Penna. No City funds will be used to pay for these services.
BACKGROUND:
The Foundation led by Mr. Greenberg has proposed to make a major investment to fully renovate the existing Roundhouse Aquarium located at the end of the pier. Mr. Greenberg is proposing to undertake this effort to honor the memory of his late son, Harrison Greenberg, who had a deep love for the ocean, marine life, and Manhattan Beach.
The aquarium is currently operated by the Oceanographic Teaching Stations, Inc. (OTS). OTS is made up of volunteers who contribute to maintain the health and safety of the marine animals under their care, and teach numerous classes to hundreds of grade-school students each year.
On March 15, 2016, the City Council approved a draft term sheet, which specified the major “deal points” between the City of Manhattan Beach, OTS, and the Foundation as a precursor to an agreement. City Council also directed staff to prepare a cooperative agreement and authorized staff to prepare and issue a Request for Proposal (RFP) to solicit the services of a Project Manager.
On July 19, 2016, City Council approved a Cooperative Agreement between all three parties. Therein the parties agreed to engage the services of a project manager to oversee development and construction of the Roundhouse Aquarium Project.
DISCUSSION:
On May 12, 2016, the City issued an RFP to procure the services of a Project Manager. Four proposals were received on June 9, 2016. Staff from the City, OTS and the Foundation reviewed the proposals and interviews were conducted with all four firms on June 29, 2016.
As a result, and with input from OTS and the Foundation, staff recommends awarding the project to Anderson Penna.
In summary, the scope of services include the following major tasks:
• Prepare a project budget and baseline schedule
• Prepare RFP for design services and manage the contract with design consultants
• Manage the preparation of plans, specifications and estimates for the project
• Perform constructability reviews of the plans and specifications
• Obtain permits for CEQA, and from the Coastal Commission, County, State, City and local jurisdictions
• Prepare RFB for construction, solicit bids, hold a pre-bid meeting and review bids and recommend an award of contract
• Assist with securing interim housing and moving the aquarium to a temporary location before construction begins
• Prepare RFP for construction management and testing/inspection services, and manage the contracts for these services
• Monitor the budget and schedule for the project
• Ensure quality assurance/quality control of the project
• Assist with closeout of the project and staff training on new equipment
• Assist with the move of the aquarium sea life back into the Roundhouse
PUBLIC OUTREACH/INTEREST:
There will be periodic presentations to City Council to provide status of the project. The community will be invited to review the information and provide comments. The selected Project Manager will meet with individual stakeholders to provide detailed project updates and solicit input.
ENVIRONMENTAL REVIEW
An environmental review will be conducted during the final design phase for the project.
LEGAL REVIEW
The agreement has been reviewed by the City Attorney and is approved as to form.
