RECOMMENDATION:
Staff recommends that the City Council discuss options related to the Parking and Public Improvements Commission (PPIC) Business Community Seat No. 2 and consider adoption of a resolution modifying the Business Community Seat to a Member At-Large seat.
FISCAL IMPLICATIONS:
There are no fiscal implications at this time.
BACKGROUND:
The Parking and Public Improvements Commission, established by resolution, consists of five members and serves in an advisory capacity to the City Council regarding public parking issues, Capital Improvement Projects (CIP), traffic management, activities within the public right-of-way including encroachment permits, undergrounding utilities, and environmental enhancements.
On October 24, 2024, the City Clerk’s office received the letter of resignation from Commissioner Becker, effectively leaving the Parking and Public Improvements Commission, Seat No. 2, Business Community seat vacant.
Manhattan Beach Municipal Code (MBMC) § 2.44.040 states, “Whenever an unscheduled vacancy occurs on a Commission, Board or Committee, a special notice is to be posted in the City Clerk’s office, and other places as directed by the City Council within twenty (20) days after the City receives notice of the vacancy.”
At the November 19, 2024, City Council meeting, the City Council approved staff’s recommendation to accept the resignation, declare the seat vacant, and asked that this item return for City Council consideration to appoint a new Commissioner from the 2024 annual Boards and Commissions interview process list or to change the Business Community Seat to a Member At-Large Seat.
DISCUSSION:
The PPIC Business Community Seat requires that the applicant own and/or operate a business located in the City (excludes home-based businesses) and have a business license registered with the City.
At the close of the extended application period to fill a vacancy on the Parking and Public Improvements Commission Business Community Seat (February 12, 2024), one resident had expressed interest in the PPIC seat, but did not meet the Business Community Seat requirement. The City Clerk’s Office had reached out to the members of the Board of Building Appeals to see if there was interest in serving in both capacities; however, those individuals did not meet the qualifications for PPIC’s Business Community Seat.
Due to the lack of qualified applicants for the Business Community Seat, the City Council decided, by Resolution, to change one of two seats designated from “Business Community” to “Member At-Large.”
On April 23, 2024, ten individuals were interviewed for two available Member At-Large seats on the Parking and Public Improvements Commission. Rosemarie Balla was appointed, and Bob DaGiau was reappointed. If the City Council proceeds with changing the seat designation to Member At-Large, the following individuals have confirmed interest in the position:

OPTION 1:
The City Council may consider adopting the resolution provided amending the PPIC’s membership requirements for Seat No. 2 (Business Community), changing the designation from “Business Community” to “Member At-Large.”
If the City Council chooses to adopt Resolution No. 24-0132, this would change the seat from Business Community to Member At-Large, and City Council can either appoint from the list of interested applicants or direct staff to conduct outreach and seek out new applicants for City Council’s consideration.
OPTION 2:
The City Council may choose to maintain the Business Community seat and direct staff to conduct public outreach. A notice will be published via the Beach Reporter, on City Hall bulletin boards, on the City’s website, the City’s social media channels, and eNotifications to website subscribers. Staff will then accept applications, schedule interviews, and agendize the appointment to this seat at a future City Council meeting.
PUBLIC OUTREACH:
After analysis, it was determined that public outreach was not required for this item. However, if the City Council directs staff to conduct public outreach, a notice will be published via the Beach Reporter, on City Hall bulletin boards, on the City’s website, the City’s social media channels, and eNotifications to website subscribers. Staff will then accept applications, schedule interviews, and agendize the appointment to this seat at a future City Council meeting.
ENVIRONMENTAL REVIEW:
The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
