Recommended Action
RECOMMENDATION:
Staff recommends that the City Council appoint/re-appoint members to the following City Board & Commission seats for a three year term and ratify the Mira Costa student nominee.  
 
Board of Building Appeals
1 Seat - (1 Experience and Training)
 
Cultural Arts Commission
Seats - (2 Members-at-Large)
 
Library Commission
3 Seats - (3 Members-At-Large)
 
Parks and Recreation Commission
3 Seats - (2 Members-At-Large & 1 Mira Costa Student Nominee)
 
Parking and Public Improvements
1 Seat - (1 Business Community)
 
If a current seated Commissioner is appointed to a vacancy, Council must declare the subject seat vacant; direct the City Clerk to post the vacancy; and appoint a member to the vacant seat at the May 21, 2013, City Council meeting.

There is no fiscal impact associated with the recommended action.
 
 
 
BACKGROUND:
The City Clerk's office placed advertisements in the March 7, 2013, and April 4, 2013, editions of the Beach Reporter, on the City's web site (www.citymb.info); on the City's posting boards; and an e-notification was sent out asking community members to apply for upcoming vacancies on the City's Boards and Commissions.  Interested individuals submitted applications to the City Clerk's office.
 
DISCUSSION:
Board of Building Appeals:  
Pursuant to provisions of the California Building Code, the Board of Building Appeals hears requests for interpretation of Uniform Code provisions, alternative materials and methods of construction. Resolution No. 5702 amended the composition of the 5-member board stating that members shall be qualified by experience and training.  Members shall first be selected from qualified electors and residents of the City of Manhattan Beach.  If there are insufficient applicants, the City Council may appoint qualified members serving concurrently on another Commission or Board.  This Commission meets on an as-needed basis.  
 
Seat No. 4 is a Member-at-Large seat currently held by Bill Simone.  While Bill Simone was eligible for re-appointment, he expressed an interest after the posted deadline, and therefore, is not eligible for consideration.

Cultural Arts Commission:  
The Cultural Arts Commission is responsible for the continued development and implementation of the master plan for cultural arts in the City, encouraging and supporting art education programs in the community and schools, visual and performing arts and Art in Public Places.  Consists of five (5) members: three (3) members selected at-large, one (1) member of the business community and one (1) member selected as an artist representative.  The Commission meets the 2nd Tuesday of every month at 6:00 p.m.
 
Seat No. 2 is a Member-at-Large seat held by Nancy Humbarger who is not eligible for re-appointment due to term limits.
 
Seat No. 4 is a Member-at-Large seat held by Russ Samuels who is eligible for re-appointment.

Library Commission:  
The Library Commission serves in an advisory capacity to the City Council regarding library services provided by the Los Angeles County Library System to the citizens of Manhattan Beach.  Also, the Commission acts as a liaison between the City and public/private community groups supportive of library services.  Consists of five (5) members who meet the 2nd Monday of each month at 6:30 p.m.
 
Seat No. 1 is a Member-at-Large seat held by Susan Adams who is not eligible for re-appointment due to term limits.
 
Seat No. 2 is a Member-at-Large seat held by Lynne Hook who is not eligible for re-appointment due to term limits.
 
Seat No. 3 is a Member-at-Large seat held by Jan Rhees who is not eligible for re-appointment due to term limits.

Parks and Recreation Commission:  
Established by Resolution No. 5365, the Parks & Recreation Commission is responsible for the recreational needs of all citizens, and shall promote supervised public recreation within the City.  Consists of seven (7) members: five (5) at large members, one (1) representative from the Manhattan Beach Unified School District and one (1) Mira Costa High School student. The Commission meets the 4th Monday of every month at 6:30 p.m.
 
Seat No. 1 is a Member-at-Large seat held by Steve Rothans who is eligible for re-appointment.
 
Seat No. 6 is a Member-at-Large seat held by Fred Manna who is eligible for re-appointment.
 
Seat No. 7 is appointed by Mira Costa High School (MCHS).  At the May 1, 2013, Manhattan Beach Unified School District meeting, the School Board approved the appointment of Madison Miketa, as recommended by Mira Costa High School.  City Council action is required to ratify the appointment of Madison Miketa to Seat No. 7 for a one year term (July 1, 2013 - June 30, 2014).

Parking & Public Improvements Commission:
The Parking & Public Improvements Commission (PPIC) is responsible for making recommendations to the City Council on policy matters pertaining to public parking, Capital Improvement Program review, and activities in the public right-of-way.  The Commission consists of five seats, three (3) Citizen-at-Large Seats and two (2) seats representing the Business Community.  The Citizen-at-Large Seats are available to any member of the community, while the Business Community representatives must be owners, employees or officers of businesses located and operating within the City.  
 
Seat No. 4 is a Business Community seat held by Lester Silverman who is not eligible for re-appointment due to term limits.
 
Individuals interested in serving on the Parking & Public Improvements Commission include:

-Mark Lipps
 
Jan Rhees expressed an interest after the posted deadline, and even though she participated in the interview process on Tuesday, April 23, 2013, she is not eligible for consideration.
 
CONCLUSION:
All Board and Commission seats which are appointed/re-appointed tonight will commence as of June 1, 2013, and will continue through May 31, 2016.
 
It is also important to note that should an existing Board or Commission member be appointed to fill a vacancy on a different Board or Commission, it would become necessary for the City Council to implement the following procedures:
1. Declare the vacancy of the open seat.
2. Direct the City Clerk's office to post the notice of vacancy.
3. Appoint a member to fill the Board or Commission noticed vacancy at the City Council Meeting of May 21, 2013.
