RECOMMENDATION:
Staff recommends that the City Council adopt Ordinance No. 25-0011, amending Section 3.68 (Mobile Vending Business) of the Manhattan Beach Municipal Code regarding mobile vending businesses.
FISCAL IMPLICATIONS:
The City anticipates increased costs to regulate and enforce a mobile vending program, however, those increased costs would be recovered through a new permit process and additional citation revenue recovered through enforcement activities.
The Mobile Vending Business Permit Fee and Appeal Fee will be considered by the City Council in a public hearing scheduled for November 4, 2025 in the event the Council adopts Ordinance No. 25-0011.
BACKGROUND:
On October 21, 2025, the City Council introduced Ordinance No. 25-0011, amending Section 3.68 (Mobile Vending Business) of the Manhattan Beach Municipal Code regarding mobile vending business permits and regulations.
CONCLUSION:
Staff recommends that the City Council adopt Ordinance No. 25-0011, amending Section 3.68 (Mobile Vending Business) of the Manhattan Beach Municipal Code regarding mobile vending businesses, and becoming effective on the 31st day after its passage.
PUBLIC OUTREACH:
On July 10, 2025, the DBPA discussed this matter at its monthly board meeting and invited City staff to attend and listen. The public, including the Downtown and North Manhattan Beach Business and Professionals Associations and Chamber of Commerce were invited to a duly noticed September 4, 2025 Parking and Public Improvements meeting as well as to the October 21, 2025 City Council meeting. The public has been informed of this agenda item as part of the City’s standard meeting notice practices via public bulletin boards, website calendar, and social media.
LEGAL REVIEW:
The City Attorney has approved the proposed ordinance as to form.
