RECOMMENDATION:
Staff recommends that the City Council approve the implementation of a Direct Invitation process for the 2013-2014 Sculpture Garden Program, a one year extension of the current installation Believe Green and Not a Step, appropriate $5,000 from the Public Art Trust Fund and authorize the City Manager to execute the attached agreement with the artists of the sculptures.

FISCAL IMPLICATIONS:
There are no fiscal implications on the general fund associated with the recommended action. The original Sculpture Garden agreements for Believe Green ended June 7, 2013 and Not a Step ends on September 6, 2013; by extending the agreements by a year, the two pieces would become part of the 2013-2014 Sculpture Garden Programs. The two separate artists would receive a stipend of $2,500 each; the total cost is $5,000. On December 15, 2009, Resolution No. 6237 was approved by City Council, and $100,000 of the Public Art Trust was committed for the annual Sculpture Garden Program; the current balance is $49,561.20. The cost for the 2013 - 2014 Sculpture Garden Exhibition of seven sculptures in total is $35,000, which leaves a committed balance of $14,561.20. The unrestricted balance in the Public Art Trust Fund is $83,890.34.
BACKGROUND:
As part of the City’s 2002 Work Plan, Council directed the Cultural Arts Commission to begin research and create a proposal for an Outdoor Sculpture Garden. The artworks contained in the Garden would rotate on an annual or semi-annual basis.
The purpose of the Sculpture Garden is to display a variety of public artwork in a community setting that prompt the viewer through thoughtful introspection and contemplation of broader public art, to bring enjoyment to our residents and visitors; and to cultivate and sustain a sense of community pride.
The Sculpture Garden’s inaugural installation took place in June 2009 with seven sculptures exhibited at three sites: the Civic Plaza, Veteran’s Memorial Parkway and the Metlox Plaza. Since 2009 the Sculpture Garden has had two additional exhibitions in 2010 - 2011 and 2011- 2012.
DISCUSSION:
Believe Green and Not a Step required additional structural engineering; therefore, it is the Cultural Arts Commission’s recommendation that the sculpture be retained for a long period of time so the City may benefit from the additional expenses. By extending the agreements for one year, the two pieces would become part of the 2013-2014 Sculpture Garden program and the Commission would bring forward five additional sculptures.
If approved, the Commission will implement the direct invitation process; whereby, selected artists would submit proposals for the Sculpture Garden’s fourth installation. The artists would be required to submit a 3-D model in 30 days.
After the Commission has reviewed the 3-D models, selections for the program’s fourth installation will be recommended to City Council for approval.
CONCLUSION:
Staff recommends that City Council approve a direct invitation process for the 2013-2014 Sculpture Garden program, approve a one year extension of the current installation; approve the appropriation of $5,000 from the Public Art Trust Fund; and authorize the City Manager to execute an agreement with the artists of the sculptures.
