Staff recommends that the City Council adopt Resolution No. 24-0125 appointing Talyn Mirzakhanian to City Manager and approving an employment agreement.
FISCAL IMPLICATIONS:
There is no budget appropriation needed related to the recommended action.
BACKGROUND:
Bruce Moe retired as City Manager effective August 18 and Talyn Mirzakhanian was named Acting City Manager effective August 19. After conducting an executive search for the City Manager, the Council gave direction to the City Attorney on October 24 to place on a City Council agenda the City Manager appointment and an employment agreement capturing the salary, benefits and terms and conditions of employment.
DISCUSSION:
An executive search for the City Manager was conducted. Following interviews with several qualified candidates in closed session, the Council gave direction to the City Attorney to develop an employment agreement with Ms. Mirzakhanian based on their direction on terms. The draft employment agreement is attached to this staff report, which includes the following key provisions:
• Annual Salary of $285,000.
• Annual City contribution to deferred compensation (401a) of 6% of base salary ($17,100 annually).
• Annual contract renewal on January 1st of each year, with City’s option to provide non-renewal notice no later than 4 months prior to the renewal period.
• 6 months’ severance if the contract is terminated by the City without cause, unless the City provides notice of non-renewal at least 4 months prior to January 1st of each year.
• All other benefits and terms of employment will be governed by the current Compensation Plan for Full-Time Unrepresented Employees <https://www.manhattanbeach.gov/home/showpublisheddocument/54541/638507647720770000>, which can be found on the City’s website.
Staff is recommending that the Council adopt the attached Resolution and Employment Agreement, appointing Ms. Mirzakhanian as City Manager, and fixing the compensation.
PUBLIC OUTREACH:
The Mayor announced at the last City Council meeting that this agreement would be considered by the Council at this council meeting.
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
