RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 23-0318 approving an agreement for the completion of the Climate Action and Adaptation Plan (CAAP) for a not-to-exceed amount of $52,112.45


FISCAL IMPLICATIONS:

On February 18, 2020, City Council awarded an agreement to Environmental Science Associates (ESA) for the Climate Resiliency Project for a total not-to-exceed amount of $370,765. This maximum compensation includes a $25,000 contingency budget. The project cost was partially offset by a $225,000 grant from the California Coastal Commission. The remainder of the project was funded through the General Fund budget in Fiscal Year (FY) 2019-2020.  Since inception of the project, $318,652.55 has been expended, and $52,112.45 remains on the original agreement.  The City’s current agreement with ESA has lapsed, therefore, a new agreement is required to be executed for a not-to-exceed amount of $52,112.45 to complete the project.

 

BACKGROUND:

In September 2019, the City issued an RFP to solicit proposals from qualified professionals with familiarity and experience with coastal resiliency, climate action and adaptation, local coastal planning, and sea level rise adaptation planning to provide project management, scientific analysis, and plans for the City of Manhattan Beach’s Climate Resiliency Project.

 

Through a bid comparison of CAAP costs, ESA proposed a budget of $99,796; BuroHappold Engineering proposed a budget of $129,960; and Rincon Consultants, Inc. proposed a cost of $162,150. ESA’s overall proposal came in at $345,765.  ESA’s competitive bid on the CAAP portion of the project, represented a financially and administratively efficient approach that would best serve the City’s needs.

On February 18, 2020, City Council awarded an agreement to ESA for a Climate Resiliency Project that included completing a sea level rise vulnerability assessment; creating a Climate Action and Adaptation Plan; and updating the City’s Local Coastal Program-Land Use Plan, Local Hazard Mitigation Plan, and General Plan.

 

In 2006, California passed the Global Warming Solutions Act, Assembly Bill (AB) 32, setting a state-wide target to reduce GHG emissions to 1990 levels by 2020. In 2016, the enactment of Senate Bill (SB) 32 extended this commitment by raising the emissions reduction target to 40 percent below 1990 levels by 2030. Overall, the state-wide target is to reduce emissions 80 percent below 1990 levels by 2050. The Climate Resiliency Project and associated CAAP will provide the path for the City to achieve compliance with these regulations. 

 

DISCUSSION:

The agreement with Environmental Science Associates, which was executed in February 2020, was initially slated to expire on May, 3, 2021. The agreement was later amended to extend the term to December 31, 2022. However, in July 2022, the Environmental Programs Administrator position was vacated, and remained vacant until June 2023. During this vacancy, Environmental Programs Work Plan items were idle, at which time, the agreement with ESA expired. With a new Environmental Programs Administrator on board, the division’s priority is to complete the Climate Resiliency Project, and the only outstanding item from the original contract scope of work is the completion of the Climate Action and Adaptation Plan (CAAP) document. Staff has received a draft of the document, and it is currently under review by various City departments. Staff recommends the City enter into an agreement for professional services with ESA to complete the CAAP.

 

PUBLIC OUTREACH:
After analysis, staff determined that public outreach was not required for this issue


ENVIRONMENTAL REVIEW:
The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus no environmental review of the contract award is necessary.

LEGAL REVIEW:
The City Attorney has approved the agreement as to form.
