SUBJECT:Title

Consideration of a Resolution Awarding a Construction Agreement to Sterndahl Enterprises LLC for $179,643 for the Cycle 1 Traffic Markings Project; and Adoption of a Determination of Exemption Pursuant to Section 15301(c) of the State California Environmental Quality Act (CEQA) Guidelines (Public Works Director Lee).

B)                     MAKE A DETERMINATION OF EXEMPTION PURSUANT TO CEQA

RECOMMENDATION:

Staff recommends that City Council:

a)                     Adopt Resolution No. 24-0012:

1.                     Awarding a construction agreement to Sterndahl Enterprises LLC for the Cycle 1 Traffic Markings Project for $179,643; and

2.                     Authorizing the City Manager to execute the Agreement; and

3.                     Approving the Specifications for the Project; and

4.                     Authorizing the City Manager and/or his or her designee to approve additional work, if necessary, for up to $17,964.30 (10% of the contract) cost.

5.                     Determining that pursuant to CEQA, the project is categorically exempt pursuant to State CEQA Guidelines Section 15301(c).

FISCAL IMPLICATIONS:

Sufficient funds of $197,607 are currently budgeted within the General Fund Public Works Department budget for the Cycle 1 Traffic Markings Project. A Budget and Expenditure Summary is attached.

BACKGROUND:

The City will initiate the Cycle 1 Traffic Markings Project, which is designed to implement traffic markings at locations identified by City staff and the Traffic Engineer on an on-call basis. Traffic markings may include thermoplastic solid, skip laneline, bike lane, pavement arrows, symbols and numbers, crosswalks, shared roadway bicycle, ADA stall symbols, and marking removals.

DISCUSSION:

Bids for the Annual Traffic Marking Project were solicited on a competitive basis in accordance with the provisions of the California Public Contract Code. The project was advertised for bid in the City’s publisher of record (The Beach Reporter), and listed on the City’s website and on PlanetBids, an online service that connects vendors, suppliers and contractors to government procurement opportunities. Two competitive bids were received on January 8, 2024. The bid results are as follows:

Contractor

Calculated Total Bid Amount

Sterndahl Enterprises LLC

$179,642.50

Superior Pavement Markings

$224,295.50

All bid submissions were analyzed for arithmetical errors, completeness, accuracy, etc. Staff reviewed the bid, contractor’s license, and references for the apparent low bidder, Sterndahl Enterprises LLC, and found them to be in order. Additionally, references indicate that Sterndahl Enterprises LLC has the knowledge and capability to complete the work in accordance with the project requirements and specifications.

Therefore, staff recommends that the City Council award a Construction Agreement to Sterndahl Enterprises LLC for $179,643 and authorize the City Manager and/or his or her designee to approve change orders for up to $17,964.30 (approximately 10% of the construction contract amount) for additional work resulting from unforeseen conditions. The work is anticipated to start as soon as the agreement is executed and will continue until funds are depleted.

PUBLIC OUTREACH:
After analysis, staff determined that public outreach was not required for this issue.

ENVIRONMENTAL REVIEW:
The City has reviewed the proposed activity for compliance with CEQA and has determined that the traffic marking project and associated contract are exempt from CEQA pursuant to Section 15301(c) of the State CEQA Guidelines. Thus, no further environmental review is necessary.

LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
