RECOMMENDATION:
Staff recommends that the City Council approve Amendment No. 2 to agreement with Community Works Design Group for additional design services for the Strand Stairs Rehabilitation Project.

FISCAL IMPLICATIONS:
The original contract with Community Works Design Group (CWDG) was approved by City Council at its May 1, 2012 meeting in the amount of $200,885 to conduct public meetings and prepare plans and specifications for construction.  The budget for design is $320,000.  There are sufficient funds available in the original design budget to fund Amendment No.2.  See Attachment 1 for the Strand Stairs Rehabilitation Project Budget and Expenditures.
 
On April 15, 2014, the City Council approved Amendment No. 1 to the agreement with CWDG for additional design services for aesthetic enhancements of the five retaining walls in the Strand Wall Repair and Enhancement Project.  City Council appropriated $25,000 from the Public Art Trust Fund for Amendment No. 1.  
 
BACKGROUND:
The original scope of work for the Strand Stairs Rehabilitation Project was to remove and/or replace stairs at twenty locations ("Removal and Replacement" at seven locations and "Repair Only" at thirteen locations) and construct two ADA compliant ramps at 26th St. and Marine Ave.  
 
A vegetated slope of varying widths and grade separates the pedestrian walkway (Strand) owned and maintained by the City and a bike path (Marvin Braude Bike Path) owned and operated by the County of Los Angeles Department of Public Works.  The boundary between the City and County is located approximately in the middle of the slope.  The County has given the City easements to maintain the existing stairs.  During the plan review process, the County indicated that the new ADA compliant ramps are not located within the existing easement agreement, thus the City will need to acquire additional right-of-way from the County for the new ADA ramps.  Since acquiring right-of-way from the County would be a lengthy process, it was decided that the ADA ramps be deferred from the project and be considered as a future project.    
 
In order to continue moving forward with the project, four additional stair locations (17th St., 19th St., 38th St. and 42nd St.) were added to the Repair Only list of the Strand Stairs Rehabilitation Project in lieu of the ADA ramps.  Furthermore, 10th St. stairs was changed from Repair Only to Removal and Replacement.  The total number of locations increased to twenty-four. See Attachment 2 for Location Map.  As a result, the plans, specifications, cost estimates and bid documents would have to be modified to accommodate the changes.
 
DISCUSSION:
The design consultant, CWDG, submitted a contract amendment proposal for the cost of changing the plans, specifications, cost estimates and bid documents, etc.  After negotiation, the cost of the proposal was finalized to $11,310.  See Attachment 3 for the Amendment 2 proposal.
 
Given the goal of completing construction by Summer 2015, both projects (Strand Stairs Rehabilitation Project and Strand Wall Repair and Enhancement Project) were advertised for bids.  For the four additional stair locations that were added to the Strand Stairs Rehabilitation Project, the plans and specifications only included enough detail so contractor can properly bid.  The plan was for CWDG to provide the detailed plans and specifications to the contractor after award of construction contract.  
 
Unfortunately, the bids for both projects came in higher than anticipated and staff is recommending for City Council to reject the bids and rebid, under a different City Council item.  The goal now is for CWDG to assess the scope of both projects and recommend changes in order to obtain lower bids when the projects are rebid, which may or may not include the additional four stair locations.  
  
CONCLUSION:
Staff recommends that the City Council approve Amendment No. 2 to agreement with Community Works Design Group for additional design services for the Strand Stairs Rehabilitation Project.
