Sepulveda Boulevard; and Making an Environmental Determination for the Project in Accordance with the California Environmental Quality Act (Community Development Director Mirzakhanian).

On February 28, 2024, the Planning Commission considered the item described below, the application for which was received by the Community Development Department on May 16, 2023.

 

1.                     Consideration of a Use Permit Amendment to allow a new outdoor seating area, alteration of an existing drive-thru lane into a two-vehicle lane drive-thru (Y-lane), and modification of the parking lot configuration at an existing commercial building located at 815 N. Sepulveda Boulevard; and making an environmental determination for the project in accordance with the California Environmental Quality Act (Community Development Director Mirzakhanian).

 

The February 28, 2024, Planning Commission meeting was duly noticed on February 15, 2024. Staff received one public comment expressing opposition in advance of the hearing. Subsequent to publication of the agenda packet, two additional public comments were received opposing the project for early morning delivery truck noise, onsite vehicle congestion, trash, and restaurant related noise concerns. One member of the audience spoke in opposition of the project. After the close of the public hearing, the Commission discussed modifying conditions of approval related to drive-thru speaker noise and volume control. The Commission discussed changes to the resolution with Director Mirzakhanian and agreed upon including a condition to allow the Planning Commission to revisit the approved project on an annual review basis for compliance. Additionally, The Planning Commission discussed with Director Mirzakhanian about including a separate condition being added to the approved resolution regarding the review for compliance of the site’s speaker noise and volume control from date of approval and implementation of the project. Based on substantial evidence in the record, and pursuant to the Manhattan Beach Municipal Code, the Planning Commission adopted the resolution, approving the project and adopting the environmental determination (4-0 ayes-nays).

Pursuant to Manhattan Beach Municipal Code Section 10.100.020, Planning Commission quasi-judicial decisions will be reviewed by the Council if two Councilmembers each file a Council review form within 15 days of the Commission’s decision or if the decision is appealed by a member of the public.
