RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 26-0082:

1.                     Accepting a Temporary Construction Easement Deed for 1119 North Sepulveda Boulevard, dated June 1, 2026, made by Anthony and Joann Fanticola Family Limited Partnership, a California Limited Partnership (Property Owner); and

 

2.                     Authorizing the City Manager and/or his or her designee to execute the Temporary Construction Easement and any other forms necessary on behalf of the City, and to record said grant of rights; and

 

3.                     Authorize payment to the Property Owner of Forty Thousand Five Hundred Dollars ($40,500.00).

 

FISCAL IMPLICATIONS:

The Manhattan Beach and Sepulveda Boulevard Intersection Improvement Project (Project) is included in the City’s Capital Improvement Program (CIP) Plan with a budgeted cost of $2,460,593 in the Proposition C Fund. Funding for this project consists of a $2,046,000 grant from the Measure R South Bay Highway Program and $414,593 in Proposition C local return funds.

 

Based on the Appraisal Report prepared by Interwest, dated August 21, 2025, the value of the Temporary Construction Easement Deed is $40,500 for the property located at 1119 North Sepulveda Boulevard, which is within the project’s budget. A Budget and Expenditures Summary Report is provided as an attachment.

 

 

BACKGROUND:

The Manhattan Beach and Sepulveda Boulevard Intersection Improvement Project was approved as part of the City’s FY 2016-2017 CIP.  The project is needed because the volume of left-turning vehicles at this intersection is very high, and the intersection lacks sufficient left-turn capacity to accommodate it. This Project will create dual left-turn lanes in all directions by installing a second left-turn lane in the following directions:

 

                     Eastbound Manhattan Beach Boulevard to northbound Sepulveda Boulevard

                     Northbound Sepulveda Boulevard to westbound Manhattan Beach Boulevard

                     Westbound Manhattan Beach Boulevard to southbound Sepulveda Boulevard

 

The project also includes other associated improvements such as extension of the median island along Sepulveda Boulevard at 11th St; modifying storm sewers to improve drainage; adjusting traffic signals, signs, and pavement markings; upgrading curb ramps to meet the Americans with Disabilities Act (ADA), landscape/irrigation restoration, and other appurtenant work.

 

Sepulveda Boulevard is State Route 1 through the City of Manhattan Beach and therefore, Caltrans will be a partner in the review and approval of this project.


DISCUSSION:

Construction of the project requires space for equipment, placing materials, and conducting construction activities. The City’s public right-of-way does not provide sufficient space for these purposes. Therefore, temporary use of adjacent private property is necessary to successfully construct the project.

 

Staff approached the owner(s) of 1119 North Sepulveda Boulevard to negotiate use of a portion of the property during construction. As part of the negotiations, the City’s consultant (Interwest) prepared an Appraisal Report to determine the fair market value of temporary use of the property during construction (called a Temporary Construction Easement). The property owner(s) agreed to the compensation amount as consideration for the temporary use of the property during construction.

 

Previous right-of-way dedications have been secured, and temporary construction easements from all other properties have been obtained; therefore, upon execution of this easement, the Project can move to the final engineering in conformance with the Caltrans process.

 

This intersection is located in an area of the City with limited on-street parking and moderately heavy pedestrian usage. The design and subsequent construction will take into account the need for the lowest possible impact on the livelihood of the residents, visitors, and business owners.

 

PUBLIC OUTREACH:
The Project has been discussed with the property owners within and adjacent to the Project area. The Temporary Construction Easement was agreed to by the Property Owner of 1119 North Sepulveda Boulevard.

 

This Project was discussed at the September 1, 2015, January 3, 2017, August 18, 2020, and August 24, 2021, January 17, 2023, and February 21, 2023 City Council meetings. Staff will continue to maintain regular communication with the Property Owner to keep them abreast of the Project schedule and impacts during the design and construction phases of this Project.

 

Public outreach to residents and businesses regarding the design and construction impacts will kick off as the Project ends the right-of-way acquisition phase, progresses through final engineering, and approaches construction. Regional outreach will also be required to inform South Bay commuters of the potential impacts.

 

ENVIRONMENTAL REVIEW:
The City has reviewed the proposed acceptance of easement activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no further environmental review is necessary.

 

LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
