RECOMMENDATION:
Staff recommends that the City Council:
1) Formally accept as complete the Aneen Construction, Inc. (Aneen) construction agreement for the Joslyn Center Crosswalk Improvement Project;
2) Authorize the filing of the Notice of Completion with the County Recorder; and
3) Authorize the release of the retention of $56,699.65 to Aneen Construction, Inc.
FISCAL IMPLICATIONS:
The construction agreement with Aneen for the Joslyn Center Crosswalk Improvement Project was awarded for $961,140, with an authorized contingency amount of $173,005. Two change orders were authorized on the project for $172,853, which increased the total amount expended on the contract to $1,133,993. After the acceptance of the work, filing the Notice of Completion, and expiring the 35-day lien period, the retention amount of $56,699.65 will be released to the contractor. Any remaining funds will be returned to the CIP Fund.
BACKGROUND:
The pedestrian crosswalks at Valley and 17th Street (midblock crossing in front of the Joslyn Community Center), Ardmore Avenue and 17th Street, Valley Drive and 18th Street (midblock crossing in front of the Live Oak Park playground), and Ardmore Avenue and 18th Street were uncontrolled crossings along the major routes for people traveling within and through Manhattan Beach. The purpose of the Project was to improve safety at the above-mentioned high flow crossings by implementing treatments that enhance pedestrian safety and increase visibility and awareness for both drivers and pedestrians.
On August 24, 2021, City Council approved a Professional Services Agreement for engineering design, and the design was completed in June 2023.
On December 19, 2023, City Council awarded a construction agreement to Aneen for this project.
DISCUSSION:
The Project began construction in February 2024 and was completed in August 2024. The project scope included the following improvements:
• Removing existing curb ramps and constructing the Americans with Disabilities Act (ADA) compliant ramps
• Building a new ADA-compliant path in the Veterans Parkway greenbelt
• Installing Rectangular Rapid-Flashing Beacon (RRFB)
• Removing existing striping and installing a thermoplastic continental crosswalk
• Installing ADA parking symbols and rearranging parking spaces
• Installing new signs
Two change orders were necessary to complete the project satisfactorily. Change Order Nos. 1 and 2 included added area to the scope to include sidewalk widening near 17th and 18th Streets along Valley Drive, which abutted the installed crosswalks, unforeseen water pipe relocation within the Veterans Parkway greenbelt, and the addition of a raised curb to the ADA path in the greenbelt at 17th Street.

Aneen has satisfactorily completed all work and is now requesting formal project acceptance. The five percent retention amount of $56,699.65 will be released 35 days after the recordation of the Notice of Completion with the County Recorder. All work inspected by the Public Works and the Parks and Recreation Departments was found to be in conformance with the plans and specifications and of good quality.
Consistent with industry standards, a warranty inspection will be conducted in the summer of 2025. Any areas observed during the warranty inspection that require remediation will be repaired at that time. This warranty work is included in the construction contract.
PUBLIC OUTREACH:
This Project was discussed at the August 24, 2021, City Council meeting to start the design process. Public outreach meetings were conducted during the design phase of the Project to inform the public of the proposed improvements and their benefit to the community. All public comments and recommendations regarding the design and equipment details were analyzed and considered, as appropriate, during the design phase. Additionally, the Project was presented at the October 26, 2023 Parking and Public Improvements Commission (PPIC) meeting to review the Project design details and construction schedule. Mailers were sent to properties in the area of the improvements notifying them of the PPIC meeting discussion.
Throughout the project, construction updates were posted on the project-specific page on the City website.
ENVIRONMENTAL REVIEW:
The City reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and determined that the project qualified for a Categorical Exemption pursuant to Section 15301 Class 1(c) (repair and maintenance of existing public facilities, involving negligible or no expansion of use) of the State CEQA Guidelines. A Notice of Exemption was filed with the Los Angeles County Clerk’s Office for the Project.
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
