RECOMMENDATION:

Staff recommends that the City Council adopt: (1) Ordinance No. 26-0002 to establish a Development Impact Fee Program; and (2) Resolution No. 26-0018, to set a Development Impact Fee Appeal Fee.

 

BACKGROUND:

After conducting a public hearing on February 3, 2026, the City Council introduced Ordinance No. 26-0002, that would, if adopted, add Chapter 8.40 to the Manhattan Beach Municipal Code regarding a Development Impact Fee (“DIF”) Program. (See attached link for the February 3 staff report.)

 

Ordinance No. 26-0002 establishes an appeal procedure under which an applicant may appeal a DIF to the City Council. The Ordinance provides that the City Council will set an appeal fee by resolution. The proposed DIF Appeal Fee is $1,500, which does not exceed the reasonable costs of providing the service. The preliminary/estimated staff costs to process a DIF Appeal is approximately $4,614. However, staff proposes setting the DIF Appeal Fee at $1,500 to facilitate appeals.


CONCLUSION:

Staff recommends that the City Council adopt: (1) Ordinance No. 26-0002, adding Chapter 8.40 (“Development Impact Fees”) to the Manhattan Beach Municipal Code to establish a Development Impact Fee Program; and (2) Resolution No. 26-0018, setting a DIF Appeal Fee.
