RECOMMENDATION:
Staff recommends that the City Council:
1. Authorize the City Manager to execute a contract in the amount of $262,745 with Kalban, Inc. for the CDBG Curb Ramps Construction Project;
2. Authorize the City Manager to approve additional work, if necessary, in an amount not-to-exceed $52,549 (20%);
3. Approve the Plans and Specifications for the CDBG Curb Ramps Construction Project.

FISCAL IMPLICATIONS:
Funding for the CDBG Curb Ramps Construction Project was approved as part of the City’s Capital Improvement Plan (CIP) by City Council in the amounts indicated in the Budget and Expenditure Report (Attachment 1).
The allocated CDBG funds must be utilized by April 2017 and all applicable documents submitted to the Los Angeles County Community Development Commission (LACDC) by June 2017.
BACKGROUND:
The City of Manhattan Beach has participated in the CDBG Program implemented by the LACDC for the past 20 years. On September 6, 2016 the City Council conducted a Public Hearing and adopted Resolution No. 16-0054 authorizing the use of funds for the construction of accessible curb ramps consistent with the approved 2017-2021 Capital Improvement Plan (CIP). This Project will remove existing curb barriers at 30 street intersections near schools and other high pedestrian use areas throughout the City (see Attachment 2, CDBG Project Location Map).
DISCUSSION:
Construction Bid Proposals
The CDBG Curb Ramps Construction Project bids were solicited on an open and competitive basis in accordance with the provisions of the Federal requirements and State Public Contract Code. The project was advertised for bids in the Beach Reporter, the City’s publisher of record, local minority newspaper and several standard construction industry publications, including the Dodge Green Sheet, Reed Construction Data, and Associated General Contractors of America.
A total of seven (7) construction bids were received and opened on October 19, 2016 (Attachment 3). The bids ranged from the low bid of $262,745 by Kalban, Inc. to the highest bid of $521,950. Kalban’s bid was reviewed by the Public Works Department and determined to be responsive. Representatives of agencies where work has been previously performed by Kalban, Inc. have indicated that the work performed was to their satisfaction. The project was discussed with a representative of the firm and he expressed confidence in his bid and the desire to perform the work.
Staff recommends awarding the construction contract (Attachment 4) to Kalban Inc. in the amount of $262,745. The work is anticipated to be completed within two months upon commencement of construction. The construction contractor’s scope of work includes the following:
1. Constructing 55 concrete curb access ramps at 30 street intersections citywide
2. Constructing concrete cross-gutters and spandrels.
3. Remove and replace portions of concrete sidewalk
4. Restore approximately 44 existing survey markers
Additional of Construction Contingency
It is recommended that the City Manager be authorized to approve potential additional work through contract change orders in an amount not-to-exceed $52,549 (20% of bid). This Project has a higher probability for encountering unforeseen conditions because it involves grading and excavation that may require removal of unsuitable soil materials including rocks, roots, abandoned footings, etc. resulting in the need to import suitable subgrade soil, retrofit of existing irrigation system, restoration of existing landscape/turf area, construction of retaining curb at the back of the access ramps to minimize impacts to adjacent private properties and extended traffic control measures at the busy intersections.
POLICY ALTERNATIVES:
ALTERNATIVE #1:
Do not approve the attached Construction Contract for the Project.
PROS:
Federal CDBG funds may not be spent by the required April 2017 deadline. There will be no disruption to the public due to construction activity.
CONS:
Public Works staff has determined that the proposed work will need to be addressed at some point in the future. These recommended access ramps are much needed to improve pedestrian mobility. The CDBG grant will expire if the funds are not expended in a timely manner.
PUBLIC OUTREACH/INTEREST:
The businesses and residences impacted by this project will be provided with written notices regarding project information, including dates and times of the construction. Contact information will also be provided for residents who require additional information.
ENVIRONMENTAL REVIEW:
The City has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1(c) categorical exemption pursuant to Section 15301, Existing Facilities, of the State CEQA Guidelines. Thus, no further environmental review is necessary.
LEGAL REVIEW:
The City Attorney has reviewed approved the Construction Contract as to form.
