RECOMMENDATION:
Staff recommends that the City Council:
1. Formally accept as complete the EBS General Engineering, Inc. construction agreement for the CDBG Cycle 3 ADA Curb Ramp Project; and
2. Authorize the filing of a Notice of Completion with the County Recorder; and
3. Release the retention of $8,874.50 to EBS General Engineering, Inc.
FISCAL IMPLICATIONS:
The CDBG Cycle 3 ADA Curb Ramp Project construction agreement was awarded to EBS General Engineering, Inc. (EBS) for $176,030, with an authorized construction contingency amount of $17,603, for a total construction budget of $193,633. The contractor has completed all work for a total construction cost of $177,490 and is now requesting formal acceptance of the project.
After formal acceptance of EBS's work and the filing of the Notice of Completion, retention totaling $8,874.50 will be released to the contractor after a 35-day lien period. The unexpended amount of $16,143 from the Grants and Other Outside Funds will be disencumbered for use on other future CDBG projects.
BACKGROUND:
The City of Manhattan Beach has participated in the Los Angeles Urban County CDBG Program, implemented by the Los Angeles County Community Development Authority (LACDA), for the past 20 years. On April 15, 2014, the City Council approved the current Participating City Cooperation Agreement in the Los Angeles Urban County CDBG Program. On June 6, 2023, the City Council authorized expenditure of the CDBG funds for construction of accessible curb ramps consistent with the approved Fiscal Year 2024 through 2028 CIP Plan. The project improved existing access ramps to comply with the latest ADA standards along routes to schools.
On May 7, 2024, City Council awarded a construction agreement to EBS for the construction of the CDBG Cycle 3 ADA Curb Ramp Project (LACDA Project No. 602599-23). The contracted scope of work consisted of replacing nine pedestrian ramps at three separate intersections. On July 7, 2024, City Council approved Resolution Nunc Pro Tunc No. 24-0079 correcting clerical errors relating to the amount of the contract award and the contingency authorization.
DISCUSSION:
Construction began on October 15, 2024 and was completed November 12, 2024. The City processed one change order in the amount of $1,460 for additional pavement restoration work and quantity adjustments, bringing the total cost of construction to $177,490.

The Contractor has completed all contract work and is now requesting formal acceptance of the project.
On January 28, 2025, LACDA performed a Labor Compliance File Review for the project. No deficiencies were noted during the review, and a Labor Compliance Clearance letter was subsequently issued on January 30, 2025.
The retention amount of $8,874.50 will be released 35 days after recordation of the Notice of Completion with the County Recorder. All work inspected by the Public Works Department has been found to be in conformance with the plans and specifications and of good quality.
PUBLIC OUTREACH:
The work was coordinated and scheduled to minimize impacts to the area residents and businesses. Additionally, notifications were delivered to nearby properties in advance of the work.
ENVIRONMENTAL REVIEW:
The project was previously evaluated for compliance with the California Environmental Quality Act (CEQA), and a determination was made that the project qualified for a Categorical Exemption pursuant to Section 15301(c) of the State CEQA Guidelines (the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use; including existing highways, streets, or sidewalks). There are no features that distinguish this project from others in the exempt class; therefore, there are no unusual circumstances.
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
