RECOMMENDATION:

Staff recommends that the City Council:

1.                     Approve a three year professional services agreement and a one year optional extension with Consultant in the total amount of  $121,360, and

2.                     Authorize City Manager to execute agreement

FISCAL IMPLICATIONS:

Funds are budgeted in the FY2015-2016 Public Works Department's Storm Drain Maintenance operating budget for these services.

 

BACKGROUND:

The National Pollutant Discharge Elimination permit (Permit) identifies conditions, requirements and programs that municipalities must meet to protect regional water resources from adverse impacts associated with pollutants in stormwater and urban runoff as mandated by the Federal Clean Water Act and the California Porter-Cologne Act.  Given the technical nature of the Permit and numerous required tasks, the City of Manhattan Beach has always used professional consultants to assist City in meeting and maintaining Permit compliance.  For the past 8 years, Ms. Kathleen McGowen (Consultant) has been providing said professional services to the City of Manhattan Beach.  

 

DISCUSSION:

Since City’s contract with Consultant has expired, there is a need to enter into a new agreement for said services.  Given Ms. McGowen’s impeccable regional reputation, technical knowledge, cost effectiveness, and superior customer service to the City of Manhattan Beach, staff recommends executing an agreement with McGowen Consultant LLC.  Along the same lines, the Cities of Hermosa Beach, Redondo Beach, Torrance, and Los Angeles County Flood Control District (Group) have selected this Consultant to help Group through the implementation of the Enhanced Watershed Management Program (EWMP) and Coordinated Integrated Management Plan (CIMP) as required by the Permit.  Group has asked the City of Manhattan Beach to include the scope and fees associated with the implementation of EWMP and CIMP to our agreement.  If scope and fee are approved as part of this agreement, a Memorandum of Understanding with the Group would come to City Council for approval at a subsequent meeting.     

 

Tasks 1 through 6 of the Consultant’s proposed fee of $60,300 would assist the City in meeting its individual requirements under the MS4 Permit during FY2015-2016 while the EWMP is under review by the Los Angeles Regional Water Quality Control Board (Regional Board).  Once the EWMP is approved by the Regional Board, which is anticipated to occur by the end of April of 2016, the MS4 Permit requires the City to begin implementing the more prescriptive minimum control measures specified in the permit.  This will require significant revisions to four of the City’s stormwater programs:

                     Public Agency Activities

                     Illicit Connection & Illicit Discharge Elimination

                     

Upon approval of the CIMP by the Regional Board, which is anticipated in September 2015, the Group has 90 days to begin implementing the CIMP.  As mentioned, the Group decided that utilization of the services of the Consultant to provide the day-to-day staffing for this effort and to provide regulatory and technical assistance as described in Task 7 of the Scope of Work would work best (Attachment 1). The Group recommends that the City of Manhattan Beach include Consultant’s this scope of work and has committed to equal cost-sharing of Task 7 ($61,060) through reimbursement to the City of Manhattan Beach.

 

CONCLUSION:

Staff recommends that the City Council approve a three year professional services agreement and a one year optional extension with Consultant in the total amount of  $121,360 and authorize City Manager to execute agreement.
