RECOMMENDATION:
Staff recommends that the City Council waive formal bidding per Manhattan Beach Municipal Code (MBMC) Section 2.36.140 (waivers) and adopt Resolution No. 22-0138 approving Amendment No. 1 to the Professional Services Agreement with Contemporary Services Corporation (CSC) for unarmed security services to extend the term and increase the maximum compensation to an estimated annual value of $390,000.

FISCAL IMPLICATIONS:
Sufficient funds are available in the Fiscal Year 2022-2023 Police Department budget. Future years will be budgeted accordingly for this service.
BACKGROUND:
Since 2007, the City has contracted with CSC for unarmed event security, crowd management, and traffic control services at large scale special events, such as the Holiday Fireworks, Manhattan Beach 10k Run, Grand Prix Bike Race, Tour de Pier, Surf Festival/6-Man Volleyball, Hometown Fair, Manhattan Open, and Pumpkin Races.
During the pandemic, CSC was used to augment public safety presence through the Ambassador Program, where they were tasked with a variety of responsibilities that included crowd control, face covering education, parking management, and patrol assistance. The Police Department continues to deploy the Ambassadors Program on an as-needed basis in areas like the Downtown and El Porto when crowds are expected, i.e. busy summer weekends and holidays.
Augmenting Police Department staff and volunteers with additional personnel experienced in crowd control, perimeter security, and traffic control has proven to be very successful, for both special events and through the Ambassador Program. The contractor’s staff provides a visual deterrent for inappropriate behavior and criminal activity, while enforcement remains the responsibility of the Police Department.
DISCUSSION:
On September 1, 2020, City Council awarded Request for Proposal (RFP) #1240-20 to Contemporary Services Corporation (CSC) for a three-year unarmed security services contract with an optional two-year extension and an annual value of $300,000. CSC was selected for their experience with large-scale events of a dynamic nature, including traffic control (both vehicular and pedestrian) at street intersections, physical security screening, access control, crowd management, and experience directly facilitating events and deployments with law enforcement staff.
They also have a cadre of local staff available to respond to both planned and emergent unarmed guard needs.
City Council approved an additional budget appropriation of $90,000 in fiscal year 2021-2022 to continue the Ambassador Program.
The proposed Amendment No. 1 extends the term of the agreement two years (through 2025) and increases the annual value of this year, and future years, to the align with the current budgeted amount of $390,000. This brings the five-year maximum compensation to $1,770,000. Because the requested increase exceeds $50,000, it would necessitate another formal written competitive bid process. However, under MBMC Section 2.36.140, the City Council may waive purchasing procedures to fit a specific purchase or service.
Staff recommends that the City Council waive formal bidding per MBMC Section 2.36.140 (waivers) and approve Amendment No. 1 to the Agreement with Contemporary Services Corporation for unarmed security services with an estimated annual value of $390,000, and a maximum compensation of $1,770,000. The City may cancel the contract at any time without cause upon a 30-day notice.
PUBLIC OUTREACH:
After analysis, staff determined that public outreach was not required for this issue.
ENVIRONMENTAL REVIEW:
The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary.
