RECOMMENDATION:
Staff recommends that City Council:
a) Adopt Resolution No. 23-0033:
1. Awarding a construction agreement to Gentry General Engineering, Inc. for the Citywide Concrete Repairs Cycle 2 Project for $439,475.25; and
2. Authorizing the City Manager to execute the Agreement; and
3. Approving the Specifications for the Project; and
4. Authorizing the City Manager and/or his or her designee to approve additional work, if necessary, for up to $43,947.75.
b) Determine that the Project Qualifies for a Categorical Exemption Pursuant to Section 15301 Class 1 of the State CEQA Guidelines.
FISCAL IMPLICATIONS:
Funds for the Citywide Concrete Repairs Cycle 2 Project are programmed in the Annual Citywide Concrete Repair Program within the Gas Tax Fund (formerly Streets & Highways Fund). Sufficient funds are available to complete the full bid’s scope of work estimated at $439,475.25 and additional unforeseen work, if necessary, for up to $43,947.75. The total amount of this contract is not to exceed $483,423.
BACKGROUND:
The Annual Citywide Concrete Repairs Program is designed to perform concrete repairs throughout the City at locations identified by City staff, property owners, and members of the public. Repairs may include replacement of cracked, damaged, or lifted sections of roadway or sidewalk, reconfiguration of non-compliant Americans with Disabilities Act (ADA) ramps, removal of obstructions, and/or correction of drainage issues. Where necessary, a portion of the project budget may be used to make concrete improvements (i.e. new curb, gutter, and/or sidewalk) ahead of roadway resurfacing or slurry application. Depending on the location, concrete repairs may eliminate trip hazards, increase pedestrian accessibility, reduce ponding of surface water, and improve roadway safety and ride-ability.
DISCUSSION:
Bids for the Project were solicited on a competitive basis in accordance with the provisions of the California Public Contract Code. The project was advertised for bid in the City’s publisher of record (The Beach Reporter), listed on the City’s website, and on PlanetBids, an online service that connects vendors, suppliers and contractors to government procurement opportunities. Two competitive bids were received on March 6, 2023. The bid results are as follows:

All bid submissions were analyzed for arithmetical errors, completeness, accuracy, etc. Staff reviewed the bid, contractor’s license, and references for the apparent low bidder, Gentry General Engineering, Inc., and found them to be in order. Additionally, references indicate that Gentry General Engineering, Inc. has the knowledge and capability to complete the work in accordance with the project requirements and specifications.
Therefore, staff recommends that the City Council award a Construction Agreement to Gentry General Engineering, Inc. for $439,475.25 and the City Manager and/or his or her designee be authorized to approve change orders for up to $43,947.75 (approximately 10% of the construction contract amount) for additional work resulting from unforeseen conditions and utility interferences. The work is anticipated to start in June 2023 and to be completed by June 2024.
PUBLIC OUTREACH:
Prior to construction, notices will be sent to the businesses and residences impacted by this project with information including locations, dates, and times of construction. Contact information will also be provided for those who require additional details.
ENVIRONMENTAL REVIEW:
The City has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Categorical Exemption pursuant to Section 15301 Class 1 (C) (Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities) of the State CEQA Guidelines. A Notice of Exemption was filed with the Los Angeles County Clerk’s Office for the Project.
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
