Recommended Action

RECOMMENDATION:
Staff recommends that the City Council:

 

1.                     Formally accept as complete the Cycle 2 Storm Drain Infrastructure Improvement Project constructed by Ramona, Inc.;

 

2.                     Authorize filing of the appropriate Notice of Completion with the Los Angeles County Recorder’s Office;

 

3.                     Approve release of retention for $31,655.16 to Ramona, Inc.

 

4.                     Adopt Resolution No. 22-0076 authorizing the City Manager to execute Contract Change Order #3 (Final) with Ramona Inc. for $41,394.97 under the Cycle 2 Storm Drain Infrastructure Improvement Project contract for unanticipated storm drain repairs completed on The Strand and 41st Street and The Strand and 43rd Street. (Attachment);

 

5.                     Authorize a contract change order to increase the contract with Ramona, Inc. by an additional $7,428.20 to cover the cost of the emergency repairs.


FISCAL IMPLICATIONS:

Funding for the Cycle 2 Storm Drain Infrastructure Improvement Project is approved in the Stormwater Fund within the City’s approved Capital Improvement Plan. The City awarded a construction contract award to Ramona, Inc. for a total not to exceed $625,675, an amount which included an authorized construction contingency amount of $81,600. The original contract work was completed at the cost of $591,708.23.

 

During the course of construction, unanticipated and urgent repair work needed to be performed as significantly deteriorated pipes and sinkholes were discovered at three locations. As Ramona Inc. was already on-site performing pipe repairs and replacements, staff directed the contractor to complete this emergency work. The cost associated with this unanticipated and urgent repair work totaled $41,394.97, an amount that is above the remaining $33,966.77 available on the contract. This final change order will add an additional $7,428.20 to make up the difference between these amounts, increasing the final contract amount to $633,103.20. Sufficient funds exist as part of the project’s overall budget within the Stormwater Fund.

 

BACKGROUND:

In December 2020, City Council awarded a $544,075 construction contract to Ramona, Inc. for the project and authorized an additional construction contingency amount of $81,600 for a total construction budget of $625,675. The Cycle 2 Storm Drain Infrastructure Improvement Project consisted of excavation, installation of reinforced concrete pipe (RCP), installation of Cured in Place Pipe (CIPP) via Ultra Violet (UV) curing methods, rehabilitation of manholes, required ADA compliant curb ramp replacement, asphalt and concrete trench and street repairs, and all appurtenant work as shown on the plans and delineated in the specifications. The project included over 1500 linear feet of reinforced concrete and CIPP mainline spot repairs at the following 11 locations in the City:

2.                     Bell Avenue and 36th Street

3.                     25th Street and Highland Avenue

4.                     Highland Avenue and 26th Street

5.                     Palm Avenue and Rosecrans Avenue

6.                     Morningside Drive and 12th Street

7.                     Ardmore Avenue and Poinsettia Avenue

8.                     8th Street and Redondo Avenue

9.                     Wendy Way and 23rd Street

10.                     Marine Avenue and Aviation Boulevard

11.                     The Strand and 39th Street

 

DISCUSSION:

Construction of the Cycle 2 Storm Drain Infrastructure Improvement Project began in the winter of 2020 and was completed on October 15, 2021. Final project completion was delayed due to additional emergency work requested by the City within the Storm Drain Infrastructure Improvement project limits.

 

While Ramona, Inc. was on site, the City encountered several unanticipated pipeline failures. First, in July of 2021, the City experienced a failure of a water main on Manhattan Beach Blvd adjacent to Polliwog Park. While City crews were able to address the water main failure, Ramona Inc. was tasked with restoring the trench and paving the adjacent areas. Due to the immediate risk to public safety, Ramona, Inc. was quickly mobilized to address the issue.

 

Then, in August 2021, the City discovered failed corrugated metal storm drainpipes at The Strand and 41st Street and The Strand and 43rd Street. The storm drainpipe in this location had entirely corroded away, leaving a sinkhole in the planter west of The Strand. Due to the appearance of sinkholes and the immediate risk of failure of the road surface in the El Porto Parking Lot, the City again directed Ramona, Inc. to replace the corroded corrugated metal storm drain with reinforced concrete pipe. This urgent work was satisfactorily completed for $41,394.97.

 

The contractor has completed all work for a total construction cost of $633,103.20 and is now requesting formal acceptance of the project. The five percent retention amount of $31,655.16 will be released 35 days after the recordation of the Notice of Completion with the County Recorder. All work inspected by the Public Works Department has been found to be in conformance with the plans and specifications and of good quality.

 

PUBLIC OUTREACH:
Staff distributed construction notices to area residents and maintained regular communication with the property owners to keep them abreast of the project schedule and impacts during construction.


ENVIRONMENTAL REVIEW:

The City has previously determined that the project qualifies for a Categorical Exemption pursuant to Section 15301 Class 1(d) (repair and maintenance of existing public facilities, involving negligible or no expansion of use) of the State California Environmental Quality Act (CEQA) Guidelines.

 

LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
