RECOMMENDATION:

Staff recommends that City Council adopt Resolution No. 23-0147 approving Amendment No. 3 to the Construction Management and Inspection Professional Services Agreement with Ardurra Group, Inc. for the Polliwog Lower Playground Replacement Project in the amount of $49,128.06.

FISCAL IMPLICATIONS:

The Polliwog Park Lower Playground Replacement Project was approved in the 5-Year Capital Improvement Program (CIP) Plan, as amended by subsequent City Council action on December 20, 2022, with a total budget of $2,950,000 in the CIP Fund. The Project’s expenditures are partially offset by grant reimbursements from the County and State in the amount of approximately $950,000.  Funds are available in the Project budget for Amendment No. 3 to the Construction Management and Inspection Professional Services Agreement with Ardurra Group, Inc.  A Budget and Expenditures Summary is attached to this report.

 

BACKGROUND:

On October 19, 2021, the City Council awarded a professional services agreement with Ardurra Group, Inc. for construction management and inspection services. Amendment No. 1 was authorized by City Council on December 20, 2022 for services through February 2023. The costs incurred were due to the long delay in receiving the playground equipment and the necessary redesign to avoid the active shallow sewer line. The City Manager authorized Amendment No. 2 on August 21, 2023 for services through August 2023 due to further schedule impacts from the unusually wet winter season.

 

During the final stages of construction, the project site was again impacted by weather due to Tropical Storm Hilary in late August 2023. Following the tropical storm, the Metropolitan Water District (MWD) performed necessary water system flushing to ensure water quality standards were maintained. The water flushed by MWD from the drinking water system was discharged into the storm drain system that drains into Polliwog Lake and kept the construction site submerged for approximately one week.

 

In all, the project construction encountered a number of challenges including global supply chain disruptions during the COVID-19 pandemic, the need to modify an 18-inch active sewer line determined to be in conflict with the playground equipment that required a redesign of the playground layout, and unusual inclement weather and flood basin impacts. Nevertheless, the Project was fully completed and opened to the public with great joy and excitement on September 26, 2023.

 

DISCUSSION:

The project team is currently completing punchlist items onsite and conducting final change order negotiations. It is anticipated that construction management services will be required through October 2023 to oversee the final work effort to complete the construction and then close-out the Project. Staff therefore recommends that City Council approve Amendment No. 3 to the Construction Management and Inspection Professional Services Agreement with Ardurra Group, Inc. for the Project.

 

PUBLIC OUTREACH:  

Extensive outreach was conducted during the Planning and Design Phase for this project in the selection of the design of the new play equipment. Area residents were notified of the construction prior to the Contractor’s mobilization in June 2022. Updates of the construction and timeline were posted on the City’s Project website at least monthly. Project signage with a QR code directing the public to the Project website were also posted at several locations around the construction site. Additionally, City staff has closely coordinated with MBUSD staff on all pertinent aspects of the Project affecting the nearby middle school and Begg Pool access.

 

ENVIRONMENTAL REVIEW:

The City has reviewed the proposed Project for compliance with the California Environmental Quality Act (CEQA) and has determined that the Project qualifies for a Categorical Exemption pursuant to Section 15302(b) (replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced) of the State CEQA Guidelines. A Project Notice of Exemption was filed with the Los Angeles County Clerk’s Office.

 

LEGAL REVIEW:

The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
