Recommended Action
RECOMMENDATION:
Staff recommends that the City Council:
1. Formally accept the construction contract for the Parking Structure No. 2 Rehabilitation Project as complete;
2. Authorize filing of the appropriate Notice of Completion and the release of retention in the amount of $37,038 to Caltec Corporation.
FISCAL IMPLICATIONS:
On March 1, 2016, the City Council awarded the construction contract for the Parking Structure No. 2 Rehabilitation Project in the amount of $630,000 to Caltec Corporation and authorized a construction contract contingency in the amount of $94,500. On August 2, 2016, the City Council approved an additional contingency in the amount of $30,000 for unforeseen work related conditions during construction. The revised total authorized contract and contingency amount is $754,500. The final completed construction contract cost is $740,757.
BACKGROUND:
Parking Structure Lot #2 is located at 222 12th Street in Manhattan Beach. This parking facility was built in 1979 and is a reinforced concrete structure with cast-in-place concrete columns. In September 2013, an assessment of the existing conditions of this parking structure was performed by Walker Restoration Consultants. The items requiring attention at this parking structure included: repairs to damaged post tensioned tendons in the deck concrete slab; installation of a vehicular barrier system; installation of a height restraint bar at the upper level entry to prevent large heavy load vehicles from driving on the parking structure deck; and re-striping of the parking stalls to meet current ADA Code requirements.
Due to height restrictions, Parking Structure Lot #2 could not accommodate the required number of ADA handicap parking stalls to meet ADA Code. The surface parking lot across the street from Parking Structure Lot #2 was modified to include the required number of ADA handicap parking stalls.
DISCUSSION:
The final completed construction contract cost is $740,757. In order to complete construction of the project, change orders were issued to the Contractor. The Contractor performed various additional unforeseen work in the amount of $110,757. Payment for the additional work is within the authorized construction contingency of $124,500. The additional work items included:
• The as-built drawings for this parking structure showed the existing concrete slab on the upper deck to be 5-inch thick. However, when demolition began to replace the post tensioned tendons, it was discovered that the concrete slab was only 4-inch thick. Since the concrete slab was thinner than anticipated, some of the rebar was laying directly on the post-tensioned tendons, and Caltec Corporation had to demolish more concrete slab in order to remove the post-tensioned tendons. Because there is inadequate concrete coverage on the rebar and post-tensioned tendons, a 1” concrete topping will need to be installed on the existing concrete slab. The anticipated schedule for the installation of this concrete topping is January 2017.
• Existing slopes at the surface parking lot had to be adjusted to meet requirements for ADA handicap parking stalls.
• Plates and posts had to be furnished for the parking meters that were to remain but interfere with post tensioning of the parking structure concrete slab.
The Public Works Department has determined that the Contractor has now completed the work satisfactorily and in accordance with the contract documents. Therefore, City Council is requested to:
1. Formally accept the construction contract for the Parking Structure No. 2 Rehabilitation Project as complete;
2. Authorize filing of the appropriate Notice of Completion and the release of retention in the amount of $37,038 to Caltec Corporation.
POLICY ALTERNATIVES:
Do not accept the construction contract as complete and do not release the retention amount.
PROS:
Funds would not be expended because the retention amount would not be released. However this would be inconsistent with the provisions of the executed contract that the contractor must be fully paid for the work completed.
CONS:
The contractor may be entitled to contract dispute claims resulting in additional costs incurred by the City.
PUBLIC OUTREACH/INTEREST:
City staff performed outreach to residents and businesses before construction started.
ENVIRONMENTAL REVIEW
Based on the California Quality Act (CEQA) requirements, a Notice of Exemption was filed for the project with the Los Angeles County Clerk’s office.
LEGAL REVIEW
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
