Consideration of a Resolution Approving a Four-Year Agreement with Yunex, LLC for On-call Emergency Response Services for Streetlights and Flashing Lights for an Amount Not-to-Exceed $400,000 (Public Work Director Lee).

RECOMMENDATION:

Staff recommends that the City Council:

 

a)                     Waive formal bid requirements pursuant to Manhattan Beach Municipal Code Section 2.36.150 (cooperative purchasing); and

b)                     Adopt Resolution No. 24-0034 approving a three-year agreement with Yunex, LLC for on-call emergency response services for streetlights and flashing lights for an amount not to exceed $400,000; and

c)                     Authorize the City Manager to extend the agreement term for up to two additional one-year periods, if deemed in the City’s best interest.

 

FISCAL IMPLICATIONS:

Sufficient funding for the agreement is available within the Street Lighting & Landscaping and Building & Grounds Maintenance Funds. Future years will be budgeted accordingly.

 

BACKGROUND:

In 2019, the City purchased 927 streetlights from Southern California Edison (SCE). Since that acquisition, Public Works has been responsible for the maintenance, repair, and replacement of these streetlights. Given the nature and complexity of streetlights, the City has historically contracted for the maintenance and repairs of this equipment.


DISCUSSION:

Under this proposed contract, Yunex will provide the City with on-call streetlight maintenance and emergency repair services. Additionally, the contractor will provide emergency and/or regularly scheduled maintenance as deemed necessary by the City.

 

Emergency service includes:

                     Emergency response to accident

                     Pole knockdown - make safe and dispose of pole; or salvage and stack pole

                     New pole installation

                     Pole foundation replacement

                     LED fixture replacement

                     Mast arm replacement

                     Wiring repair

                     Overhead wire replacement

 

Scheduled service includes:

                     All operations and repairs from the pull box or bottom of streetlight pole at the fuse holder or secondary power source as necessary to keep all streetlights operational

                     Associated wiring within the streetlight circuit

                     Traffic control

                     General cleaning during call-out

                     Photocell replacement

                     Fuse replacement

                     Fuse holder replacement

                     Hand hole covers

                     False call response

 

The recommended purchase is being achieved utilizing the City’s cooperative purchasing or “piggybacking” policy. This policy allows for the extension of pricing, terms, and conditions of one agency’s contract to other governmental agencies with the mutual consent of all parties. In June 2020, the City of Orange issued a Request for Proposal (RFP) 190-59 soliciting prospective firms to provide on-call signal and lighting emergency repair services and publicly awarded the contract to Siemens Mobility Inc. (Yunex, LLC) in accordance with their procurement regulations.

 

Staff recommends that the City Council waive formal bid requirements pursuant to Manhattan Beach Municipal Code Section 2.36.150 (cooperative purchasing) and adopt Resolution No. 24-0034 approving a four-year agreement with Yunex, LLC for on-call emergency response services for an amount not to exceed $400,000.

 

Additionally, staff recommends the City Manager be given the authority to administratively exercise the two one-year options to extend the term of the agreement, if deemed in the City’s best interest.

 

 

PUBLIC OUTREACH:
After analysis, staff determined that public outreach was not required for this issue.

ENVIRONMENTAL REVIEW:
The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that there is no possibility that the activity may have a significant effect on the environment; therefore, pursuant to Section 1506 (b)(3) of the State CEQA Guidelines, the activity is not subject to CEQA; thus no environmental review is necessary.

LEGAL REVIEW:
The City Attorney has approved the agreement as to form.
