Recommended Action
RECOMMENDATION:
Staff recommends that City Council authorize the City Manager to:
 
1.      Authorize final payment in the net amount of $50,112.98 to Nobest, Inc., for the Section 2 Concrete Repair and Miscellaneous Slurry Project
 
2.      Authorize filing of the appropriate Notice of Completion and Release Retention in  the amount of $56,931.19

FISCAL IMPLICATIONS:
Sufficient funds were approved and allocated for this project in the approved Proposition 42 Gas Tax funded portion of the Capital Improvement Budget and the Public Works Operating Budget (School Maintenance, Account 100-18-043-5101).
 
BACKGROUND:
This project was part of the City's ongoing concrete repair and maintenance program.  The annual program removes and replaces damaged or displaced concrete sidewalks, curbs, gutters, drive approaches and drainage swales in the City's right-of-way to eliminate trip hazards and mitigate gutter ponding.  Installation of ADA access ramps at select locations are also part of this program. Concrete repairs are coordinated with established slurry seal maintenance districts.  The goal is to provide a programmed approach to street maintenance in which street repairs, slurry sealing, sidewalk repairs, and traffic markings are completed within the same year and in the corresponding district. Work under the program is performed through a competitively bid contract.
 
Completion of this Section 2 project completes one seven-year concrete repair cycle.  Since the Section 2 project included streets near Mira Costa High School, it was decided to include slurry seal of these streets in this contract in order to minimize impacts and complete improvements while students were on summer break.  The remainder of the slurry seal will occur upon completion of several water and sewer line projects that are within the Section 2 and 3 repair areas in 2015.
 
The City is responsible for all concrete improvements within the right-of-way except sidewalks and drive approaches which are the responsibility of adjacent property owners.  The City's Municipal Code assigns the responsibility for repairing sidewalks and driveways to adjacent property owners (Chapter 7.12.010 -7.12.030).  The competitively bid contract ensures residents who must effect repairs to the sidewalks adjoining their properties receive the best possible value.  Work completed under this contract which is adjacent to private property will be billed to the property owner and the funds reimbursed to the Prop. 42 Gas Tax Fund.
 
Additionally, as part of the Master Agreement between the Manhattan Beach Unified School District (MBUSD) and the City of Manhattan Beach, the City was obligated to seal coat all school playgrounds and parking lots. This work was included in this contract. The school sites had an abbreviated summertime window in which work could be performed. This project contains completed work at the following school locations:
 
·      Grandview Elementary School
·      Ladera School
·      Meadows Elementary School
·      Manhattan Beach Middle School
·      Pacific School
·      Pennekamp School
·      Robinson Elementary School
 
The work at the school sites consisted of crack sealing, seal coating, slurry application, and restriping of all courts and parking lots. The project also included the resurfacing of 6 paddle tennis courts at the Manhattan Beach Middle School site. As planned, all work was completed by August 15, 2014 and avoided conflicts related to the start of the fall school semester.
 
Staff has included concrete work valued at approximately $331,000 in the completed contract that will be reimbursed to the City by property owners as sanctioned by Manhattan Beach Municipal Code Chapter 712.010-7.12.030.  Funds to cover this portion of the project will be refunded to the Prop.42 Gas Tax unreserved fund balance upon payment by the property owners.
 
Notification of Property Owners:  
Staff notified all affected property owners in late March of 2014 and again in early summer of the impending concrete repair project.  The notices explained their responsibility for repairs to the sidewalk and driveway and described the sidewalk repair program, the competitive bidding process and costs associated with the repair work.  
 
DISCUSSION:
Nobest, Inc. completed all sealcoat application work to the identified school sites, slurry, striping and concrete repairs of the area within the Mira Costa vicinity (the area bounded by Artesia Blvd., Manhattan Beach Blvd., Peck Ave. and Meadows Ave.) on or before August 15, 2014 as prescribed by contract.
 
During the course of construction, remediation of long standing ponding water issues were addressed at two locations, Rowell Ave. between 3rd St. and 5th St. and 7th Pl. west of Valley Drive. Dependent on location, work included re-work of the curb and gutter, drainage swale and surrounding asphalt and concrete streets to establish proper elevation control and positive drainage. As has been our policy, standing water issues are prioritized to eliminate potential mosquito breeding sites, arrest continued pavement deterioration and ameliorate nuisance to pedestrians and the motoring public.
 
All remaining sidewalk, curb and gutter, driveway and ADA ramp installations have been completed in their entirety and inspected by staff. The work is in compliance with contract specification
 
CONCLUSION:
Nobest, Inc. has completed slurry seal, seal coat, and all routine concrete repairs to contract specification. Staff recommends that the City Council approve the final payment for the Section 2 Concrete Repair and Miscellaneous Slurry Project to Nobest, Inc. and accept the project as complete.
