RECOMMENDATION:
Staff recommends that the City Council adopt Resolution No. 26-0104, amending the Conflict of Interest Code (COIC) for the City of Manhattan Beach.
FISCAL IMPLICATIONS:
There are no fiscal implications associated with the recommended action.
BACKGROUND:
California law requires each local government agency to adopt a Conflict of Interest Code that identifies designated positions with authority to make or participate in governmental decisions and specifies the financial interests that must be disclosed on the California Form 700 by individuals serving in those positions. Agencies are required to review and amend their Conflict of Interest Code when organizational or operational changes require updates.
The Conflict of Interest Code and Form 700 serve two important purposes. First, they help public officials identify and avoid potential conflicts of interest in the performance of their duties. Second, they promote transparency and accountability, thereby preserving public confidence in governmental decision-making.
A Conflict of Interest Code consists of three primary components:
1. Incorporation Section:
This section identifies where Form 700 Statements of Economic Interests are filed and maintained and incorporates California Code of Regulations Section 18730, which establishes the standard conflict-of-interest provisions, including disqualification requirements, disclosure obligations, and applicable gift limits.
2. List of Designated Positions:
The Code identifies positions that make or participate in making governmental decisions that may foreseeably have a material effect on a financial interest. These positions may include employees, officers, and members of boards, commissions, and other decision-making bodies.
3. Disclosure Categories:
Disclosure categories specify the types of financial interests that designated officials must report on their Form 700. Each category is tailored to the responsibilities of the position and the types of financial interests that may be affected by decisions made in the course of official duties.
DISCUSSION:
A Conflict of Interest Code must accurately reflect an agency’s current organizational structure and identify all designated officials and employees required to file a Statement of Economic Interests (Form 700). Pursuant to California law, local agencies are required to review their Conflict of Interest Codes biennially to ensure they remain current and accurately reflect agency positions and reporting requirements.
The attached resolution amends the City of Manhattan Beach Conflict of Interest Code to comply with these requirements. The proposed changes are intended to ensure that designated positions and disclosure categories remain consistent with the current organizational structure and responsibilities of each agency.

PUBLIC OUTREACH:
After analysis, staff determined that public outreach was not required for this issue.
ENVIRONMENTAL REVIEW:
The City has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary.
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
