Recommended Action
On February 22, 2023, the Planning Commission considered the item described below:
1. Use Permit Amendment to allow alcohol sales (the sale of beer and wine only for on-site consumption) at an existing “Eating and Drinking Establishments” use located at 321 Manhattan Beach Boulevard in the Downtown Commercial (CD) zoning district. Per LCP Section A.16.020(L), a use permit, or use permit amendment, shall be required for any new alcohol license within the Downtown Commercial (CD) zoning district. (Bluestone Lane restaurant)
On September 9, 2021, the Community Development Department received an application requesting an amendment to a use permit, to allow alcohol sales, specifically on-site consumption of beer and wine only (Alcohol Beverage Control License Type 41 - On-sale Beer and Wine - Eating Place), at an existing “Eating and Drinking Establishment” use (Bluestone Lane) located at 321 Manhattan Beach Boulevard. The existing use currently operates in accordance with Resolution No. PC 96-11, which approved an “Eating and Drinking Establishment” use for the site on May 8, 1996.
The February 22, 2023 Planning Commission meeting was duly noticed on February 9, 2023, and the Planning Commission agenda with staff report and attachments was published on February 16, 2023. Staff received one public comment on the day of the Planning Commission meeting. At the meeting, the individual who provided the public comment spoke at the meeting regarding impacts on residential properties and Alcohol Beverage Control (ABC) noticing requirements. Based on substantial evidence in the record, and pursuant to the Manhattan Beach Local Coastal Program and other applicable law, the Planning Commission adopted the resolution unanimously approving the project and adopted the environmental determination, in accordance with staff’s recommendation.

Pursuant to Section 10.100.010 of the Manhattan Beach Municipal Code, Planning Commission quasi-judicial decisions can be called up for review by a Councilmember or appealed by any member of the public within 15 days of the decision (March 9, 2023).
