Staff recommends that City Council adopt Resolution No. 23-0019:
1. Approving Measure R Funding Agreement Amendment No. 3 between the Los Angeles County Metropolitan Transportation Authority (LACMTA) and City of Manhattan Beach for $1,066,000 in additional Measure R grant funds to fund the development of design plans, specifications, right-of-way acquisition, and construction of the Manhattan Beach Boulevard (MBB) and Sepulveda Boulevard Intersection Improvement Project.
2. Authorizing the City Manager and/or his or her designee to execute the Measure R Grant Funding Agreement Amendment No. 3 and any subsequent administrative amendments.
3. Appropriating $1,066,000 from the Proposition C Fund in the Capital Improvement Plan (CIP) for the Manhattan Beach Boulevard and Sepulveda Boulevard Intersection Improvement Project and adjusting corresponding revenues.
FISCAL IMPLICATIONS:
The MBB and Sepulveda Boulevard Intersection Improvement Project is included in the City’s Capital Improvement Program (CIP) Plan with a budgeted cost of $1,394,593 in the Proposition C Fund. Funding for this project consists of a $980,000 grant from the Measure R South Bay Highway Program and $414,593 in Proposition C local return funds.
On January 19, 2022, LACMTA approved a $1,066,000 increase to the Measure R South Bay Highway Program grant associated with the project to fund the remaining costs of project right-of-way acquisition and construction. Should City Council approve the amendment to the grant funding agreement under consideration, the total LACMTA Measure R grant funding associated with this project will increase to $2,046,000. There are no matching funds required for this grant.
Approval of the amendment under consideration would increase the total project’s budget by $1,066,000 to a total of $2,460,593. To accommodate the increase in project expenditures, an appropriation is required from the Proposition C Fund balance. Budgeted revenues will be adjusted in the Proposition C Fund by $1,066,000 to include the increase to grant funds for the project. The project’s Budget and Expenditures Summary Report is provided as an attachment to this staff report.
BACKGROUND:
On September 1, 2015, City Council approved a $980,000 Measure R South Bay Highway Program Funding Agreement with LACMTA for the intersection’s turn movement improvements at MBB and Sepulveda Boulevard. The original Measure R funding agreement is provided as an attachment. The improvements include providing dual left-turn pockets in the following directions:
• Eastbound Manhattan Beach Boulevard to northbound Sepulveda Boulevard
• Northbound Sepulveda Boulevard to westbound Manhattan Beach Boulevard
• Westbound Manhattan Beach Boulevard to southbound Sepulveda Boulevard
This intersection is located in an area of the City with limited on-street parking and moderately heavy pedestrian usage. The design and subsequent construction take into account the need for the lowest possible impact on the livelihood of residents, visitors, and business owners. There are five approved resolutions on file that contain rights-of-way dedications from the existing properties on the northwest, southwest, and southeast corners of MBB and Sepulveda Boulevard, which include:

On August 25, 2020, LACMTA approved a Funding Agreement Amendment No. 1 to extend the lapsing date of Fiscal Year 2015-2016 funds to June 30, 2021, which is provided as an attachment to this staff report.
On October 4, 2021, LACMTA approved a Funding Agreement Amendment No. 2 to extend the lapsing date of the project funds to June 30, 2023, which is provided as an attachment to this staff report. Staff is currently working with LACMTA to secure another extension of this grant funding.
During January 19, 2022, Board meeting, LACMTA approved additional Measure R funding in the amount of $1,066,000 to cover the cost of the remaining right-of-way acquisition and construction. In January 2023, LACMTA staff finalized and approved a Funding Agreement Amendment No. 3 for City approval and execution, which is provided as an attachment to this staff report.
On September 23, 2022, the project team sent the 6th submittal of the design plan set to Caltrans for review. Currently, the project team is working closely with Caltrans on the design plan review. Right-of-way acquisition tasks are in process, and the project team has conducted necessary site surveys and public outreach and prepared right-of-way acquisition documentation. Right-of-way acquisitions for the southeast corner of the intersection have already been completed by the City. The project team will soon start the negotiation process with property owners for the remaining right-of-way acquisitions at the other three corners of the intersection that are needed to complete this project.
DISCUSSION:
In order to accept and utilize these Measure R grant funds, City Council must adopt a resolution approving the LACMTA Funding Agreement Amendment No. 3. This amendment outlines the scope of work, expenditures, and reporting requirements as well as the expected timeline for implementation. The Agreement contains standard boilerplate agreement language similar to previous LACMTA Funding Agreements approved by City Council for previous City projects. The attached resolution also authorizes the City Manager or his or her designee to sign the Funding Agreement Amendment No. 3 and any subsequent administrative amendments, if necessary, due to minor variations or adjustments to the terms and conditions therein.
The previously approved funding amount of $1,394,593 is designated to cover the Project for the engineering design, environmental clearance, and part of the construction costs. The additional funding amount of $1,066,000 will cover the project’s remaining right-of-way acquisition and construction costs.
PUBLIC OUTREACH:
No public outreach was conducted related to the execution of the attached amendment. However, this project was discussed at September 1, 2015, January 3, 2017, August 18, 2020, September 21, 2021, and January 17, 2023 City Council meetings. Staff will continue to maintain regular communication with the property owners and businesses to keep them abreast of the project schedule and impacts during the design phase of this project.
ENVIRONMENTAL REVIEW:
No environmental review was conducted related to the execution of the attached amendment. However, the project team has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and determined that the project qualifies for a Categorical Exemption pursuant to Section 15301 Class 1 (repair and maintenance of existing public facilities, involving negligible or no expansion of use) of the State CEQA Guidelines. A Notice of Exemption was filed with the Los Angeles County Clerk’s Office for the project.
LEGAL REVIEW:
The City Attorney has reviewed this report and determined that no additional legal analysis is necessary.
