RECOMMENDATION:
Staff recommends that the City Council receive and file the Planning Commission Approval of Resolution No. PC 14-11 (Attachment 1) for a Use Permit for a new pre-school.

There are no fiscal implications associated with the recommended action.
 
BACKGROUND:
Public hearings were held by the Planning Commission on September 10 and 24, 2014 regarding the remodel and reuse of an existing multi-tenant commercial building and a secondary office building for a new pre-school use at 1114-1126 22nd Street (Attachment 2).  The approval is to construct a new facility that includes 5 classrooms (6,371 square feet), a separate motor skills building that remodels an existing office building (1,840 square feet) southwest of the site at the rear, a 7,363 square feet outdoor playground and 12 standard, 5 compact and 1 ADA accessible space for a total of 17 parking spaces.  
The Planning Commission received public comments at the public hearings and approved the Use Permit on September 24, 2014, adopting Resolution No. PC 14-11 with additional conditions to address parking, and loading and unloading issues.    
 
DISCUSSION:
The Planning Commission's discussion at the public hearings focused on sufficient parking for teachers and staff and the location for the drop off and pick up of students.  Overall, the Planning Commission was in support of the project and felt that that a pre-school was much needed in the community and the modern design was an efficient use of the existing buildings.
 
The Planning Commission considered the neighbor's concerns regarding parking and the traffic generated from the drop off and pick up of students on-site.  The City Traffic Engineer recommended the following conditions be added to the Resolution to address their concerns:
 
Condition No. 7 states that the applicant must maintain a Traffic Operations and Management Plan, per the Traffic Study conducted on July 10, 2014, which is to be followed by faculty, staff, students and parents, and will be reviewed and approved by the Community Development Department.  The Plan will include information on parking operations, site access, circulation procedures, and pick up and drop off operations.
 
Condition No. 8 states that the public parking spaces on the west side of Cedar Avenue may be used for loading and unloading of students and that the parking spaces on both sides of 22nd Street, west of Cedar Avenue may be used by teachers and staff. This will allow the full use of the parking lot on-site by parents during drop off and pick up of students.  The public parking spaces on 22nd Street and Cedar Avenue will remain open and available for employees, visitors and the general public during school hours.     
 
CONCLUSION:
Staff recommends that the City Council receive and file Planning Commission Resolution No. PC 14-11, approving a Use Permit for the remodel and reuse of existing commercial buildings for a new day care use.
